Fish Farm Concession - Amendment.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for decision:

The Minister is responsible for the issue of fish farming licences on the seabed under the Sea Fisheries (Establishment and Regulations of Fisheries)(Jersey) Regulations 1998.

Mr J. Surcouf has advised the Department that he wishes to amend his current Act of Authorisation from the name “J. Surcouf “ to his company name “Ormer and Scallops of Jersey Limited”.

Officers believe there is nothing in the regulations that would prevent this and there will be no change in the size of the concessions, activities permitted or any other details of the current Act of Authorisation.

Action required:

Fisheries Officers to prepare amended Act of Authorisation and forward to concession holder.

AMENDMENT TO ACT OF AUTHORISATION FOR FISH FARMING CONCESSION

Purpose of the Report

The Minister is responsible for the issue of fish farming licences on the seabed under the Sea Fisheries (Establishment and Regulations of Fisheries)(Jersey) Regulations 1998.

Background

Mr J. Surcouf currently has two fish farming concessions. One concession is subtidal, situated to the east of Jersey and is used for the farming of ormers and scallops. The other concession is intertidal and used for the farming of oysters and scallops. He also operates an ormer hatchery above Anne Port.

Mr J. Surcouf has advised the Department in writing that he wished to amend his current Act of Authorisation from the name “J. Surcouf “ to his company name “Ormer and Scallops of Jersey Limited”.

Discussion

The Sea Fisheries (Establishment and Regulations of Fisheries)(Jersey) Regulations 1998 does have a prohibition against assignment of any licence granted under Regulation 3. However, the definition of assignment refers to the transfer of rights or property from one person to another. This is not occurring on this occasion. The person to whom the original concession was granted is still responsible for those concessions. There will be no change with respect to the size of the concessions, any activities that are permitted, or any other details on the Act of Authorisation. Officers have considered the request and recommend that the amendment be approved. Mr Surcouf has supplied copies of the Memorandum and Articles of Association, as set out in Schedule 1 of the Sea Fisheries (Establishment and Regulations of Fisheries)(Jersey) Regulations 1998, together with the Certificate of Incorporation of a Limited Company.

Recommendation

The Minister is asked to endorse the view of officers and approve the amendment of the Act of Authorisation for the fish farm concessions.
