Information and public services for the Island of Jersey

L'înformâtion et les sèrvices publyis pouor I'Île dé Jèrri

Le Buissonet, La Rue du Crocquet, St. Brelade.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Site Description

A dwelling forming part of La Rue du Crocquet which is one of the Island’s most important historic streets.

Relevant Planning History

Following a complaint in October 2006 the then Enforcement Officer tried on a number of occasions to gain the applicant’s compliance in removing the render but finally submitted a Enforcement Report dated 8 January 2007 to the Minister.  The Minister, having personally visited the site authorised that an Enforcement Notice be issued requiring the applicant to replace the render by 23 March 2007.  The Enforcement notice was duly served but not complied with.

The applicant wrote to the Minister a few days before the Notice was due to expire and as a result further correspondence was exchanged between the Enforcement Officer and the applicant.  Following further intervention by Deputy Ferguson and the Connetable the deadline for the re-instatement of the render until 19 October 2007.  This was further extended to 27 October 2007 as the applicant was due to return to the Island on that date.

However on the 9 October the applicant submitted a retrospective applicant to remove the render form the property.

Consultations

Design & Conservation in their letter dated 2 November 2007     states that the principle of the proposal is not acceptable (and an enforcement notice is already in hand).  The building was not intended to be bare and poor brick window reveals indicate this.  Buttered render around the windows is highly inappropriate.  The proposal causes harm to an historic building.”

Summary of Representations

One letter of representation has been received in connection with this application from The National Trust .

Planning Issues

Policy Considerations

G13 states that there will be a presumption in favour of the architectural and historic character and integrity of registered buildings and places.  Permission will not normally be given for external works which would adversely affect the architectural or historic interest, character or setting of a registered building or place.

It is considered that the removal of the render has caused visual harm to this buildings and the area in general and therefore it fails to meet the requirements of Policy G13

Other Material Considerations

It is considered that the applicant has been given ample time to rectify the situation and the application has served to reinforce the inappropriate nature of the works to this Proposed Site of Special Interest.
