Fisheries: Increase in Fees and Charges

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

2011 increase to Fisheries fees and charges – this Ministerial Decision rescinds MD-E-2010-153

Decision(s):

The Minister approved the rescinding of MD-E-2010-153 and approved the increases to the Fisheries fees and charges as set out in the report on the basis that an Order would be made in due course

Reason(s) for Decision:

The increase in fees agreed in MD-E-2010-153 was calculated incorrectly. This Ministerial Decision enables Fisheries to increase its existing fees and charges in line with the Anti-Inflation Strategy agreed by the States.

Action required:

For the Minister to request the Treasurer of the States to approve the increases to the Fisheries fees and charges as set out in the report. For Department Officers to instruct Law Draftsman to produce the draft Order for subsequent consideration by the Minister.

ECONOMIC DEVELOPMENT  

INCREASES TO FEES  

Purpose of the Report  

The Minister for Economic Development is asked to approve a request to increase the  various fees and charges for Fisheries with effect from 1 January 2011 as per the recommendation below. 

Background  

The Department currently charges a fee for the work involved in administering the following :

Issue of new Fishing vessel licences

Issue of Professional scallop diving permits

Issue of Recreational scallop diving permits

Charging an annual fee per concession and per hectare for fish farming  

It also issues the following permits with no charge :

Granville Bay Access Permits

Granville Bay - Zone E permits

Granville Bay - Zone F permits

Beam trawling permits  
 

Discussion  

Of these fees only the Recreational Scallop permit underwent an increase in 2010 and for this reason the increase requested for 2011 corresponds to the increase in RPI of 1.43%. 

The remaining fees have remained unchanged since I January 2008 . The RPI used for the 2008 increase was 132.1 (Sept 2007) and the latest RPI available (June 2010) is 142, an increase of 7.5%. 

In accordance with Finance Direction No.4.1 Increases in States Fees and Charges, all increases to charges above 2.5% require the approval of the Minister for Treasury and Resources.  The Treasurer of the States can approve increases to States charges under his delegated powers, where those increases are non-contentious.   

Recommendations  

The Minister is recommended to approve the increase to fees and charges as set out below :

Transfer of Fishing vessel licences – from £85.60 to £92.00

Issue of Professional scallop diving permits – from £75.30 to £80.95

Annual fee per fish farming concession – from £155.80 to £167.50

Charge per hectare for fish farming – from £23.60 to £25.40 

Issue of Recreational scallop diving permits – from £16.70 to £16.90  

This Ministerial Decision rescinds MD-E-2010-153.
