Water Pollution (Code of Good Agricultural Practice) (Jersey) Order 2009: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister requested the Law Draftsman to provide for the extension of the Water Pollution (Code of Good Agricultural Practice) (Jersey) Order 2009 as an approved Code of Practice under articles 16 and 52 of the Water Pollution (Jersey) Law 2000 until further notice.

Reason(s) for Decision: To allow for full consultation with interested parties to revise the existing code in line with the Nitrate Working Group recommendations.

Proposal for an extension to the Water Code Order

Purpose of the Report

 

The purpose of this report is to request that the Minister approve, by Order, The Water Code (Jersey) March 2009 as an approved Code of Practice for the purposes of Article 16 of the Water Pollution (Jersey) Law, 2000.  

 

Background and discussion

 

The Code of Good Agricultural Practice for the Protection of Water, The Water Code (Jersey) is an approved Code of Practice for the purposes of Article 16 of the Water Pollution (Jersey) Law 2000 and was approved by Order, The Water Pollution (Code of Good Agricultural Practice) (Jersey) Order 2009. The Order came into force on 29th June 2009 and was to remain in force for five years.

 

Article 16 of the Water Pollution (Jersey) Law 2000 states that the Minister may by Order approve any code of practice for the purposes of this Law

In exercising his or her powers under paragraph (1), the Minister shall have regard to the desirability of 

(a)     the provision of practical guidance to persons engaged in activities (including, in particular, agricultural and related activities) that may affect the quality of controlled waters; and

(b)     the promotion and encouragement of good practices by such persons for preventing, controlling, reducing or eliminating the pollution of controlled waters.

 

The current Water Code (March 2009) was approved by the Minister for Planning and Environment under Article 16 of the Water Pollution (Jersey) Law 2000. It was intended to replace the current Code with a combined Soil, Air and Water Code (2014) however the intention is now to continue with the existing Water Code and update it in line with the recommendations from the Nitrate Working Group. The continued approval will allow full consultations with interested parties to be carried out.

 

Recommendation

 

That the Minister instructs the Director of Environmental Management and Rural Economy to request that the Law Draftsman amend the Water Code Order 2009 as per the brief provided by the Department.
