La Collette Flats, Green Street, St. Helier - Building of Local Interest.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

The purpose of this report is for the Minister to confirm the removal of La Collette Flats, Green Street, St Helier from the List of Sites of Special Interest and its retention on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest.

Background

The Island Development Committee added La Collette Flats to the List of Sites of Special Interest in 1972. A request to reconsider this Listing was submitted to the Minister in July 2006. The Minister determined, on 10 April 2007, that La Collette Flats does not satisfy the published criteria for designation as a Site of Special Interest, but that it retains sufficient architectural and historic interest to satisfy the published criteria for selection as a Building of Local Interest. A Site Notice was fixed near the building on 10 April and a notice of Intention to remove the building from the List and a letter of notification of the Minister’s intention to retain the building on the Register as a Building of Local Interest were issued to Property Holdings on 10 April 2007. The Department was subsequently advised that the notice should be served on the Housing Department: this was issued on 20 April, and although 28 days since that date has not yet elapsed the Minister for Housing has confirmed that his Department do not wish to make any representation to the Minister’s intention to remove the building from the List (email attached).

Recommendation

It is recommended that the Minister confirms the removal of La Collette Flats, Green Street, St Helier from the List and its retention on the Register as a Building of Local Interest.
