Firearms Dealer: Application Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION:

 

The Assistant Minister for Home Affairs approved an application by Mr Maurice Francis Gotel for re-registration as a firearms dealer. The application has been considered in accordance with the process and criteria for the registration of firearms dealers and is subject to conditions as outlined in the attached report.

Firearms Dealer: Application Approval

 

Application for Re-Registration as a Firearms Dealer – Mr Maurice Gotel

 

Report for the Assistant Minister for Home Affairs

 

 

 

In accordance with Article 20 of the Firearms (Jersey) Law 2000, Mr Maurice Gotel has submitted an application to the Minister for Home Affairs for re-registration as a firearms dealer.

 

Mr Gotel is requesting a continuation of his current certificate, which permits Mr Gotel to conduct business as M.F Gotel Guns (Game and Clay). The nature of the business is the “Purchase and sale of firearms and ammunition. The repair, servicing, and testing of firearms and component parts and the sale of component parts.”

 

The Firearms Registrar at the States of Jersey Police has undertaken a visit to the premises where Mr Gotel’s business is based. The security arrangements in place were found to be satisfactory. Two minor recommendations for further enhancing the security have been made.

 

The certificate of re-registration, which will be for a period of 3 years, will also be subject to conditions.

 

These matters have been discussed with Mr Gotel prior to the certificate being issued.

 

The relevant Connétable has been informed of the application and of the Assistant Minister’s intention to renew Mr Gotel’s registration as a firearms dealer, subject to certain conditions.

 

The application has been handled in accordance with the process and criteria for the registration of firearms dealers. This was agreed in September 2016 by the Firearms Liaison Group which includes representatives of the firearms community, States of Jersey Police, Comité des Connétables and Community and Constitutional Affairs.

The certificate is subject to conditions, including:

 

  • The certificate holder to only conduct work on firearms which are held on a personal or club certificate;

 

  • The certificate holder is required to hold public liability insurance to provide cover in the event where a firearm, which has been serviced or repaired, malfunctions and causes injury to any person;

 

  • All testing of firearms must take place on an approved shooting range / on the premises of an approved shooting club;

 

  • A register is to be kept of all firearms that are serviced or repaired and purchased or sold (including component parts and ammunition), and made available (subject to reasonable notice being given) to the States of Jersey Police and/or the Minister for Home Affairs. The Register shall be retained for a period of 10 years after the date of the last entry;

 

  • The firearms, component parts and ammunition held in respect of this Certificate of registration shall at all times when not in use be stored in a safe and secure area, preventing access by unauthorized persons;

 

  • All personal firearms are to be kept separate from firearms held under this certificate.
