Bee Diseases Control (Jersey) Order 1992 - Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister agreed that the Bee Diseases Control (Jersey) Order 1992 should be amended to include the requirement for beekeepers to register with the Minister and to extend the definition of “disease” in Article 1 of the Diseases of Animals (Jersey) Law 1956 to include small hive beetle (Aethina tumida)  and Tropilaelaps mite (tropilaelaps spp).

 

Reason(s) for Decision:

To set appropriate controls for notifiable diseases and to assist the dissemination of relevant information.

Purpose of the Report

 

To assist with control of notifiable diseases and dissemination of information, it is necessary for bee keepers to be registered with the Minister and to make two exotic parasites namely small hive beetle Aethina tumida and Tropilaelaps spp., notifiable diseases in the island.  

 

Background
 

Since 3 June 2010 the island has been an infected area for American Foulbrood. Whilst the infected area notice is in place restrictions apply and one of the requirements is that beekeepers must register with the Minister. This requirement will fall when the infected area notice is lifted. In 2010 84 cases of American Foulbrood were confirmed.  8 cases were confirmed in 2011 and 4 cases to date in 2012.

 

Small hive beetle can multiply to huge numbers within infested colonies where it eats brood, destroys combs and if uncontrolled ultimately destroys the colony. The Tropilaelaps mite can cause high mortality in bee colonies and deformities of legs and wings. If introduced to Jersey, either of these exotic parasites could have devastating consequences on the health status of the honey bees. Neither the small hive beetle nor the Tropilaelaps mite have been found in Jersey, UK or Europe. Both diseases are notifiable in the European Union.  

 

Discussion

 

The Order is to be amended to require an owner or person in charge of any hives to register with the minister and from time to time when requested, register the location of apiary sites and the number of colonies they are in charge of. The Jersey Bee Keepers Association supports the requirement for bee keepers to register.

 

The Order is also to be amended to make small hive beetle and Tropilaelaps mite notifiable diseases.

 

Recommendation

 

The Minister is recommended to make an Order to make:

  1. Small hive beetle (Aethina tumida) and Tropilaelaps mite (Tropilaelaos spp.) notifiable diseases.        
  2. Bee keepers register with the minister and from time to time provide information about the location of apiary sites and the number of hives on each site they own or are in charge of.
