Jersey Child Care Trust: Appointment of Chairperson

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister decided to present a Report to the States, giving 15 days’ notice of his intention to re-appoint Marnie Baudains as the Chairperson of the Jersey Child Care Trust in pursuance of paragraph 5.1 of the Trust’s Constitution, as amended by the Royal Court on 21st June 2012.

Reason(s) for Decision:

In pursuance of Paragraph 5.1 of the Jersey Child Care Trust Constitution, the Minister is required to give the Sates 15 days’ notice of his intention to re-appoint Marnie Baudains as Chairperson for a further period of 3 years. All the Trustees support this re-appointment.

Notice of Re-Appointment of a Chairperson

 

At its meeting of 18th February 1997, the States adopted a proposition of the Education Committee (P24496) and approved the setting up by the States of a Child Care Trust to co-ordinate, promote and facilitate expansion of child care provision in the Island.

 

Following registration of the Trust’s Constitution before the Royal Court on 5th December 1997, the Trust has supported the development of significant advances in the range, quality and quantity of child care places available for children aged up to twelve years, and has formed a close and working relationship with other agencies, both States and private, which are concerned for the welfare of children.

 

 

In pursuance of Paragraph 5.1 of the Trust Constitution, amended by the Royal Court (21st June 2012) to comply with revised procedures for appointment laid down in P205/2009 approved by the States on 2nd February 2010, the Minister wishes to give the States 15 days’ notice of his intention to re-appoint Mrs Marine Baudains as Chairperson for a further period of 3 years.  Mrs Marnie Baudains is the former Directorate Manager of Social Services. She has a broad experience in management within the public sector, a sound grasp of social, education, and health issues and a lifelong commitment to the welfare of children. Appointed in 2012, Mrs Baudains has led the Board of Trustees of the JCCT very effectively, and has the full support of trustees drawn across key States Departments, the Childcare sector and parents. The Minister is confident that Mrs Baudains will continue to bring her experience and expertise to bear as an exemplary leader in this important role. Mrs Baudains’ re-appointment to this post is supported by the JCCT Trustees.
