Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002: Temporary Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the prohibition of the return of a vehicle to a disabled parking space in St.Helier within one hour of the vehicle leaving that space.

 

Reason(s) for Decision: To improve access to disabled parking spaces in St.Helier for all disabled badge holders and to give them more choice of spaces within the town area

ROAD TRAFFIC (DISABLED PERSONS) (PARKING) ( JERSEY ) ORDER 2002 AMENDMENT TO PARKING RESTRICTIONS

 

 

Purpose of the report

 

To amend the Road Traffic (Disabled Persons) (Parking) ( Jersey ) Order 2002

 

 

Background

 

 An amendment made by the Minister to the Road Traffic ( St Helier ) ( Jersey ) Order 1996 came into effect on 13 March 2009 .  One of the provisions included a restriction on vehicles returning to an on-street paycard or disc parking space within one hour of their leaving the space.  It is proposed to extend this restriction to on-street disabled parking spaces in St Helier .

 

 

Discussion

 

Article 68 of the Road Traffic ( Jersey ) Law 1956 enables changes to Traffic Orders to be made, for a period of up to 12 months, without waiting for the relatively lengthy process of amending Orders to be completed.  During the 12 month period an amendment to the Order will be drafted, for subsequent approval by the Minister.  It is proposed to establish this new parking restriction under Article 68 of the Law.

 

The proposed restriction will improve access to disabled parking spaces in St Helier for all disabled badge holders and give them more choice of spaces within the town area.  The restriction will therefore apply to all on-street public parking spaces in St Helier .

 

 

Recommendation

 

The Minister is recommended to approve the attached notice, to come into effect within seven days of its insertion in the Jersey Gazette.

To prohibit the return of a vehicle to a disabled parking space in St Helier within one hour of the vehicle leaving that space.

 

 

 

 

 

 

Action Required

 

The Minister to instruct his officers to arrange for the notice to be inserted into the Jersey Gazette, as required by Article 68 of the Road Traffic ( Jersey ) Law 1956, on two occasions during the seven days immediately preceding the date on which it is to have effect.
