Ancillary Dental Workers (Jersey) Regulations 1974: Removal of name from Roll of Dental Hygienists

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for Health and Social Services has approved the removal of Katie Louise Green from the Roll of Dental Hygienists as stated in the report dated 11 January 2012

Reason(s) for Decision: 

(i) The failure of the Katie Louise Green to make an application to the Minister to be retained on the roll of dental ancillary workers as required by Article 10(1)(2) of the Ancillary Dental Workers (Jersey) Regulations 1974

TITLE: Ancillary Dental Workers (Jersey) Regulations 1974 - Erasure of a name from the Roll Of Dental Hygienists

 

 

Statutory Framework

 

The Minister of Health and Social Services has responsibility for the regulation of Dental Ancillary Workers including maintaining a roll for each class of worker under the above Regulations.

 

Under Article 10(2)

“Not later than the first day of December in every year, the Minister shall send to every person whose name is entered in a roll of ancillary dental workers a form of application for retention of a name in that roll, together with a notice of the fee payable and a warning that non-payment entails erasure”

 

Article 10(3) states:

“Where the Minister on the thirty first day of December in any year has not received from any person whose name is entered in a roll of ancillary dental workers a fee for the retention of that person’s name in that roll for the ensuing year, the Committee shall direct that that name be erased from the roll”

 

2012 Renewal Process

 

Notice and an application forms for retention on the roll were sent, on 07 December 2011 to all those whose names were entered in the Dental Hygienists roll in 2011.

 

The following person failed to return the requisite fee and the application for retention form by December 31st 2011:

Recommendation:

 

The Minister is asked to approve the erasure from the Dental Hygienists Roll the person named above.
