Crabbe Queen's Silver Jubilee Activity Base: Demolition and New Build: Drawings and Tender Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Demolition and new build Crabbe Queen’s Silver Jubilee Activity Base - Approval of Drawings and Acceptance of Tender

Decision(s):

 

(a)  In accordance with paragraph 1 (d) of Standing Order 168, the Assistant Minister, under delegated authority  approved drawings numbered/ref, (Planning Permit P/2013/1335) Site Plan 100B, Floor Plan 101C, Roof Plan 102, Elevation West & South 103 ,Elevation East & North 104B

(Building Permit  B/2013/0998) Location Plan, (PS496-101 Existing site Survey)(794-100 Site plan),(794-101 Floor Plan) (794-102 Roof Plan)(794-103 Elevations West and South)(794-104 Elevations East and North) (794-120 Section A-A)(794-121 Section B-B) (794-122 Section CC & DD) (794-200 Typical Detail) all showing the proposed works to Demolish and rebuild Crabbe Queen’s Silver Jubilee Activity Base

 

(b)  The Assistant Minister agreed to accept the lowest fixed price tender submitted by Rok Construction Ltd in the sum of £897,229.21, demolish and re-build new facility and enter into a formal JCT IFC 84 Building Contract.

 

Reason(s) for Decision:  

 

The drawings noted in item (a) above and which Planning approval has been granted (Permit P/2013/1335 refers) and which building permit approval has been granted (Permit B/2013/0998 refers) reflect the use for which the funding is provided

 

Under Standing Order 168 (1) (d), it is a requirement for the Minister for Treasury and Resources to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

 

The estimated total cost for the refurbishment of Crabbe Queen’s Silver Jubilee Activity Base (including the lowest tender received, professional fees and ‘other’ costs), as designed, can be completed within the allocated budget.

 

The fixed price tender in the sum of £ 879,401.53 was received.

 

Following Tender Evaluation it was agreed to reinstate the following items omitted as cost savings in Value Engineering(VE) Meeting

  1. Canopy roof to External walkway £ 8,381.99
  2. External amenity deck size increase £ 9,445.69

 

The lowest fixed price tender submitted by Rok Construction Ltd for the sum of £ 897,229.21 can be accepted and a contract entered into.

 

Resource Implications:

 

Rok Construction Ltd in agreement with (BTW) Back to Work scheme have indicated that they will employ 1 additional local apprentice attending Highlands College and also take on 2 voluntary placements. This will be monitored by Philip Le Claire (BTW) scheme who will provide feedback to JPH.

 

There are no further financial or manpower implications.

 

Action required:

 

The Assistant Minister to sign the contract and any other associated documentation in accordance with the approved scheme of delegation.
