A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision: Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year. The current Contingency Allocation Policy (published as R.110/2017) sets the requirement for all allocations from Contingency over £100,000 to be considered by the Council of Ministers prior to submission to the Minister for approval. The Council of Ministers approved this funding at its meeting on 12th July 2017. A Ministerial decision was signed by the Minister for Infrastructure on 27th November 2017.
Resource Implications: The Central Contingencies balance to decrease by £3.5 million and the Department for Infrastructure Liquid Waste Strategy Capital Head of Expenditure to increase by £3.5 million. This decision does not change the total amount of expenditure approved by the States for 2017 – 2019 in the Medium Term Financial Plan.
Action required: Head of Decision Support to advise the Finance and Information Manager – Department for Infrastructure once this decision has been approved.

Transfer of £3.5 million from Central Contingencies to the Liquid Waste Strategy in relation to the Clinical Waste Incinerator

Purpose of Report

To approve a budget transfer of £3.5million from Central Contingencies to the Department for Infrastructure Liquid Waste Strategy Capital Head of Expenditure (Q00BT14022) in order to fund the construction of a Clinical Waste Incinerator at La Collette.

Background

Part of the Liquid Waste Strategy to construct a new Sewage Treatment Works at Bellozanne requires the demolition of the existing Clinical Waste Incinerator currently located at Bellozanne and the construction of a replacement incinerator at La Collette. The funding of the new Clinical Waste Incinerator cannot be accommodated within the existing Liquid Waste Strategy budget, therefore the Council of Ministers has approved the funding of the Clinical Waste Incinerator from Central Contingencies.

3. Recommendation

The Minister is recommended to approve the transfer of £3.5million from Central Contingencies to the Department for Infrastructure Liquid Waste Strategy Capital Head of Expenditure (Q00BT14022) in order to fund the construction of a Clinical Waste Incinerator at La Collette.

4. Reason for Decision
