A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved an internal budget transfer of up to £100,000 from Central Contingency (one-off) to the Department of the Environment for Island Plan / Masterplanning work.
Reason(s) for Decision: To enable DoE to achieve the Scrutiny recommendations for the strengthening of regulation of the Island’s Environmental Protection as highlighted in the 2012 Carry Forward Reports.
Resource Implications: Other than those detailed in the report there are no further financial or manpower implications.
Action required: The Minister for the Department of the Environment to seek approval from the Minister for Treasury and Resources for the budget transfer highlighted above. The Finance Director for the Department of the Environment will then action the budget transfers in conjunction with the Head of Financial Performance Reporting.

Request for the allocation of carry forward funds from Central Contingency (one-off) to the Department of the Environment for Island Plan / Masterplanning work

Purpose of Report

To enable the Minister to accept an internal budget transfer of up to £100,000 from Central Contingency (one-off) as identified to the Department of the Environment for Island Plan / Masterplanning work..

Background

A funding pressure of £100,000 per annum from 2014 was identified by Scrutiny and detailed in the Medium Term Financial Plan (MTFP) Second Amendment to “deliver and implement outstanding and overdue policy requirements of the Island Plan 2011”.

The amendment was subsequently withdrawn; however, the 2012 Carry Forwards Report identified £100,000 from Departmental under spends which could be used by the Department for Island Plan / Masterplanning work from Central Contingency (one-off).

Discussion

The 2012 Carry Forward Report states:

“Funding pressure identified by Scrutiny and detailed in the Medium Term Financial Plan Second Amendment. To deliver and implement outstanding and overdue policy requirements of the Island Plan 2011 including masterplans, parish and local development plans, supplementary planning guidance and a replacement policy for affordable housing.”

Revisions to the Island Plan were taken to the States earlier in 2014 and this funding will enable further work to be conducted based on these revisions.

Recommendation

That the Minister accepts the internal budget transfer of up to £100,000 from Central Contingency (one-off) as identified in the 2012 Carry Forward Report to the Department of the Environment for Island Plan / Masterplanning work.

Reason for Decision

Under Financial Direction 3.6 and the Public Finances (Jersey) Law 2005, the approval of the Minister for Treasury and Resources is required for any variations to heads of expenditure.

Resource Implications

The Department of the Environment’s revenue head of expenditure will increase by up to £100,000 in 2014 and Central Contingency (one-off) to decrease by an identical amount.
