A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

In accordance with Standing Order 168 (1)(b) the Minister decided, as recommended by Jersey Property Holdings, for the Public to be party to a contract of sale between the Crown and Packer Ltd in connection with a small triangular strip of Crown owned land situated between the Dolphin Hotel (Packer Ltd), the Gorey Pier Boat Yard site (Sail Loft Gorey Ltd), and the steep pathway at Castle Green (the Public) - to ratify the boundary of the subject land towards the adjoining land in Public ownership.

Reason(s) for Decision:

It is in the Public’s interest to use this opportunity to clarify the detail of the small length of boundary between the land to be sold and the steep pathway (in Public ownership).

Purpose

 

To seek the agreement of the Minister for the Public to be party to a contract of sale between the Crown and Packer Ltd.

 

Background

 

In October 2013 the Public sold to Sail Loft Gorey Ltd the site known as Gorey Pier Boat Yard.

 

The subject site adjoins in part to the north-west to the Dolphin Hotel owned by Packer Ltd, in part to the north and north-west to a steep pathway owned by the Public (which pathway connects Mont de Gouray to the Castle Green), and in part to the north to the Castle Green, also owned by the Public.

 

In preparing the 2013 contact of sale of the Gorey Pier Boat Yard, the Law Officers’ Department discovered a small triangular strip of Crown owned land situated between the Dolphin Hotel, the site being sold, and the Public’s steep pathway - which strip of land has been encroached upon by the hotel.

 

The Law Officers’ Department negotiated terms, on behalf of the Crown, for the sale of the strip of land to Packer Ltd, and has prepared a draft contract to conclude the transaction before Royal Court.

 

Current Situation

 

The Law Officers’ Department has recommended that the Public be party to the contract of sale by the Crown to Packer Ltd in order to ratify the boundary of the subject land towards the adjoining land in Public ownership.

 

Jersey Property Holdings agrees that it is in the Public’s interest to use this opportunity to clarify the detail of the small length of boundary between the land to be sold and the steep pathway (in Public ownership). As the matter is of mutual benefit, it is not planned that the Public will seek to recover a fee for officer time from either the Crown or Packer Ltd.

 

The Sail Loft Gorey Ltd as owner of Gorey Pier Boat Yard (which is planned to be redeveloped as a restaurant) has also been invited to be party to the contract of sale to ratify the boundary towards the company’s land.

 

Recommendation

 

It is recommended that the Minister agrees for the Public to be party to a contract of sale between the Crown and Packer Ltd in connection with a small triangular strip of Crown owned land situated between the Dolphin Hotel (Packer Ltd), the Gorey Pier Boat Yard site (Sail Loft Gorey Ltd), and the steep pathway at Castle Green (the Public) - to ratify the boundary of the subject land towards the adjoining land in Public ownership.
