A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Written Report Title: Register of Buildings and Sites of Architectural, Archaeological and Historical Importance: Assessment of Sun Bowls Club, Route es Nouaux, St Helier

Decision(s): The Minister for Planning and Environment determined that;

· The Sun Bowls Club shall be added to the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a proposed Site of Special Interest and that a Notice of Intention to List the property as a Site of Special Interest shall be served on the owners of the site.

Reason(s) for decision:

· The special Interest of the Sun Bowls Club, as defined relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002;

· The proposal accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets.

Action required:

· Amend the Register

· Notify development control

· The Notice of Intention is to be served in accordance with the Law

· No sooner than 28 days after the date of the service of the Notice, a further report will be brought back to the Minister relative to any representations received.

Register of Buildings and Sites of Architectural and Historical Importance:

Assessment of Sun Bowls Club, La Route es Nouaux, St. Helier

This report has been prepared by the Jersey Heritage Trust as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the registration of historic buildings and sites.

The Planning and Environment Department requested in June 2007 that the Jersey Heritage Trust assess the architectural, historical and other interests of the Sun Bowls Club ahead of discussions with the Ministerial Registration and Listing Advisory Group.

Relevant interests of the site (also see assessment form)

The Sun Bowls Club has special historic and architectural interest. It was constructed in 1928 as a sports pavilion and bowling green for the Sun Works (Overseas Trading Corporation) and is a good quality example of 1920s recreational architecture. The pavilion retains its exterior and interior fabric and character including locally unusual timber weatherboarding, a timber verandah arcade, a cupola with weathervane, and a tearoom with barrel-vaulted ceiling, pilasters and deep cornice. The bowling green survives to the west of the pavilion.

Advice received (MRLAG or others)

MRLAG unanimously recommended that the pavilion be added to the Register as a pSSI. It was further recommended that the bowling green should be included within the registration as it is an integral part of the character, setting and history of the site.

JHT recommendation

It is recommended that the Minister for Planning and Environment:

· add the Sun Bowls Club (comprising the pavilion and bowling green) to the Historic Buildings Register as a pSSI for its special historic and architectural interest;

  approve the serving of the Intention to List Notice in accord with the requirements of the Law.

Justification relating to criteria

The registration of the Sun Bowls Club as a pSSI is in accordance with the published principles for selection as follows:

· The site retains its historic form and detail, and makes a significant and positive contribution to the architectural and historical character and appearance of Jersey.

· The special interest of the pavilion extends substantially to its authentic fabric, plan form and interior features.

  The pavilion is of special interest for its architectural design and use of materials, and the site illustrates a significant aspect of Jersey’s history.

  The pavilion is an unusual building type.

The special interest of the Sun Bowls Club, as defined and assessed relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002
