Draft Community Costs Bonus (Jersey) Regulations 202-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Lodge the Draft Community Costs Bonus (Jersey) Regulations 202-

Decision(s): The Minister decided to lodge au Greffe the Draft Community Costs Bonus (Jersey) Regulations 202-

Reason(s) for Decision: The Regulations for the current Food Costs Bonus expired on 30th June 2020.

 

The continuation of the bonus, at an increased value, was approved by the Assembly as part of the Government Plan 2020-2023.

 

The bonus Regulations were originally established to help low income households with the increase in food costs as a result of the introduction of GST. The Assembly approved an increase in value of the bonus in line with overall RPI. The change in name to the “Community Costs Bonus” reflects that the bonus is now providing financial assistance that covers a “basket” of household goods that are available to the community of the Island.

 

Aside from the change in name and the increase in value there are no other substantive changes to the previous regulations. If agreed by the Assembly, these new Triennial Regulations will provide for a bonus in 2020, 2021 and 2022.

Resource Implications: The administration of the benefit remains unchanged and there are no additional manpower implications. The increase in value to £258.25 was approved by the Assembly in the Government Plan 2020-2023. The estimated expenditure for the years that these Regulations will cover is as follows – 2020 - £340,000, 2021 - £351,000 and 2022 - £361,000

Action required: Senior Policy Officer to request the Greffier of the States to arrange for the Draft Regulations to be lodged au Greffe and to be listed for debate at the States Assembly sitting of 8th September 2020.
