Budget transfers in relation to transfer of functions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the various recurring budget transfers in 2016 following the adoption by the Assembly of P.46/2015.

Reason(s) for Decision:

Article 18(1)(b) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be transferred from one head of expenditure to another head of expenditure consequentially upon a transfer of functions by Regulations made under Article 29 of the States of Jersey Law 2005.

 

The States adopted P.46/2015, Draft States of Jersey (Transfer of Functions No. 8) (Miscellaneous Transfers) (Jersey) Regulations 201- (principles adopted on 20th October 2015), on 16th December 2015.

Resource Implications:

Economic Development, Tourism, Sport and Culture Department revenue head of expenditure to increase by a net total of £2,058,922 in 2016 and 102.5 FTEs.

Action required:

The Senior Management Accountant to inform the Head of Decision Support, Treasury and Resources that this decision has been approved.

The Greffier of the States is requested to rescind MD-E-2016-0003.

TRANSFER OF FUNCTIONS BUDGET TRANSFERS AS PER P.46/2015

 

  1. Purpose of Report

To enable the Minister approve a number of recurring budget transfers in 2016, following the adoption by the Assembly of P.46/2015 and to rescind MD-E-2016-0003.

 

  1. Background

The Chief Minister lodged proposition P.46/2015 with the intention of underpinning the Draft Strategic Plan 2015 -2018 and in particular, the need to:

 

  • deliver positive, sustainable economic, social and environmental outcomes for Jersey;
  • ensure effective, efficient and sustainable management and use of public funds; and
  • ensure the provision of modern and highly valued services for the Public.

 

3.  Budget Transfers

The following transfers are to occur,

 

  • £8,108,922, being the Sport and Culture budget, from the Education, Sport and Culture Department (now Education) to the Economic Development Department (now Economic Development, Tourism, Sport & Culture  Department) together with 106.5 FTEs

 

  • £6,050,000, being the Digital, Innovation and Competition budget, from the Economic Development, Tourism, Sport & Culture Department to the Chief Minister’s Department, together with 4 FTEs
