La Collette Car Park - permission to trade for Jersey School of Motorcycling

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (16.03.07) to approve permission for the Jersey School of Motorcycling Ltd. to temporarily trade from La Collette Car Park.

Decision(s): The Minister approved permission for the Jersey School of Motorcycling Ltd to trade from La Collette Car Park under Article 3 (d) Road Traffic (Public Parking Places) (Jersey) Order 2007.

Reason(s) for decision: The Jersey School of Motorcycling Ltd has been given permission to temporarily trade from La Collette Car Park for the provision of the off-road element of the Compulsory Basic Training whilst a long-term base is established through Property Holdings.

Action required: To instruct Parking Control Section to notify Jersey School of Motorcycling of the decision and to erect signs to this effect at La Collette Car Park.

PERMISSION FOR JERSEY SCHOOL OF MOTORCYCLING TO TRADE FROM PART OF LA COLLETTE CAR PARK

Purpose of the Report

The Minister for Transport and Technical Services is asked to approve a request to temporarily allow the Jersey School of Motorcycling Ltd to trade from La Collette Car Park.

Discussion

The Jersey School of Motorcycling Ltd has been using an area at the Connex Bus Depot to facilitate the off-road elements of the Compulsory Basic Training they provide. This area will no longer be available when the integrated service starts running in April. Property Holdings are currently searching for an alternative long-term site but have not yet found one. The Compulsory Basic Training programme is a requirement for any person who wishes to apply for a motorcycle licence.

Currently no person or Company is allowed to carry out a trade within a scheduled car park under the Road Traffic (Public Parking Places) (Jersey) Order 2006 without prior permission from the Minister.

The area would only be used for this purpose until a long-term site is identified by Property Holdings.

Recommendations

The Minister is recommended to approve the request for temporary permission to allow the Jersey School of Motorcycling Limited to trade from part of La Collette Car Park and to instruct the Parking Control Section to erect signs for this purpose.

To enable the uninterrupted provision of Compulsory Basic Training whilst a long-term site is identified by Property Holdings.

Action Required

To instruct the Parking Control Section to action the Minister’s decision.
