ST MARTINS GYMKHANA AND FETE COMMITTEE’S APPLICATION TO HOLD THE GOREY FETE 2009
Purpose of the Report
To obtain ‘Ministerial Decision’ regarding approval of road closures and traffic restrictions for the purpose of holding the Gorey Fête 2009 on Thursday 20 August 2009.
In addition, to enable an instruction to be sent to the Law Draftsman requesting preparation of an Order under Article 2 of the “Entertainments on Public Roads (Jersey) Law 1985”.
Background
The Promoter (St Martin’s Gymkhana and Fête Committee) has submitted details of its proposed road closures for the 2009 event. The event is enabled by Order of the Transport and Technical Services Minister under Article 2 of the “Entertainments on Public Roads (Jersey) Law 1985”.
As per the requirements of the Law, a draft Order has been prepared and circulated to the Connétables of Grouville and St Martin, as well as the Harbour Master (Jersey Harbours) for consultation. The Promoter has also supplied proof of public liability Insurance.
Discussion
The Order will enable the event promoter to close Gorey Pier and adjacent coach parking area for the purpose of the event, as well as to restrict traffic in the vicinity.
Restrictions for this year’s event will be similar to those of 2008 in that the Order provides for a one-way system on Gorey Coast Road, Le Mont de Gouray, Beach Road, La Route de la Côte and La Route Le Brun. These restrictions will apply from 8am on the day of the Fête until 10am the day after and are intended to reduce traffic problems, as well as aid the removal of vehicles parked on Gorey Coast Road.
The St Martin’s Gymkhana and Fête Committee have once again requested the provision introduced in to the 2006 Order giving police officers and members of the Fête Committee discretionary power to restrict traffic, in the interests of the safety of the public, where access to premises might ordinarily be granted on or adjacent to the site of the event (the Harbour Pier).
The wording for this year’s Order again contains the amendment introduced in 2006 with respect to Article 7, on the request of the St Martin’s Gymkhana and Fête Committee. Article 7(3) gives provision for a police officer or member of the Fête Committee to exercise discretionary power to restrict traffic, in the interests of the safety of the public, where access to premises might ordinarily be granted on or adjacent to the site of the event (the Harbour Pier), as set out under Article 7(1). Also this year on the request of Jersey Harbours, Article 7(2) was introduced protecting the right of foot passengers to move to and from the Ferry Terminal located at the end of the pier.
Other details are as per the 2008 Order.
Recommendation
The Minister is recommended to approve the Gorey Fête 2009 and the preparation of an Order under Article 2 of the “Entertainments on Public Roads (Jersey) Law 1985”.

To forward a copy of the Ministerial Decision along with an Instructing Memorandum and the Promoter’s Application to the Law Draftsman.
