Category 'A' Housing Development at Bel Royal - Request to release for building Block 12 (as a substitute for Block 7) and two sub-station enclosures.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  A written request from the developer dated 8th January 2008 for the immediate release for construction of:

  1. Block 12 (4 units located centrally within the site), as a substitute for Block 7 (4 units close to the northern site boundary that have previously been approved for construction, but cannot be started until the enabling works for road widening have been undertaken); and
  2. Two on-site substation enclosures (to meet the Jersey Electricity Company Ltd’s installation programme).

Decision(s):

The Minister decided to permit the release for construction under part (c) of Planning Condition No.3 attached to the original Planning Permission;

    (i)          Block 12 as a substitute for Block 7;

    (ii)          two on-site substation enclosures, on condition design details for the     

                  enclosures are submitted and agreed by the Planning Department. 

The above decision is made on the understanding that none of the homes can be occupied until the required Planning Obligation Agreement has been signed and registered and that the developers carry out these works in advance of the Agreement at their own risk. 

N.B. The Minister remains minded not to release further blocks (now including Block 7) for construction in advance of the Planning Obligation Agreement being completed and registered.

Reason(s) for Decision:

  1. to assist with the provision of homes to meet the Island’s identified requirements;
  2. to help secure the orderly development of the site;
  3. to help maintain the pressure for completing, as expeditiously as possible, the required Planning Obligation Agreement in the Public interest.
  4. to help enable the Jersey Electricity Company Ltd’s installation programme.
