Building Bye-Laws (Jersey) 2007: Amendments to Technical Guidance Documents: Requirements 2.2, 2.3, 2.4, and 2.5 of Schedule 2

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Proposed amendments to the Technical Guidance published in support of the bye-law requirements relating to Fire Safety.

 

 

 

Introduction.

Part 2 of the Building Bye-laws and the supporting Approved Technical Guidance, provides a regulatory framework and guidance on the design of buildings with respect to Fire Safety in buildings. The current approved technical guidance (ADB ) was last updated in 2000. In accordance with the Department’s 2011 business plan it is proposed to update the current guidance in line with changes to made to British and European Standards since 2000 and publish new guidance in 2012.

 

Proposed amendments.

An outline of the main changes is given in the ‘Response to Consultation’ document which is attached as an appendix to this report with the changes being set out in detail in the following two documents:

1.      Technical Guidance Document 2 (Fire safety) Volume 1: Dwellinghouses –Consultation December 2011.

2.      Technical Guidance Document 2 (Fire safety) Volume 2: Buildings other than dwellinghouses - Consultation December 2011.

Legal and resource implications

Article 31 (2) of the Planning and Building (Jersey) Law 2002 empowers the Minister to make Building Bye-laws, relating to fire safety and to publish guidance in support of such requirements. The proposed amendments involve relatively minor changes to the current provisions and as such there will be no departmental resource implications arising from the amendments.

 

Recommendation

It is recommended the Minister:

  1. Approves the issue of the attached draft consultation paper for public comment.
