63 New Street, St. Helier: Occupation by Caring Hands Charitable Trust

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister approved the occupation of 63 New Street by Caring Hands Charitable Trust under the terms contained within the Standard Tenancy Agreement.

 

Reason(s) for Decision:

That the property, having been recently refurbished for the purposes of occupation by a charitable organisation, be let to Caring Hands Charitable Trust.

 

Resource Implications:

Financial: The Housing Department will receive £16,202.16 per annum in rent and charges.

 

 

Action required: That the Minster agree to the creation of a Standard Tenancy Agreement between the Housing Department and Caring Hands Charitable Trust.

REPORT TO THE HOUSING MINISTER

 

THE OCCUPATION OF 63 NEW STREET BY THE ‘CARING HANDS CHARITABLE TRUST’

 

Purpose of Report

To seek the approval of the Minister to allow Caring Hands Charitable Trust to occupy 63 New Street under the terms of the Housing Department Standard Tenancy Agreement.

 

Background

In 2011 the property was refurbished and configured specifically for occupation by a charitable organisation; the newly refurbished building provides Nos 6 rooms for occupation on the following basis: 2 single rooms; 3 double rooms and 1 Caretaker room.

 

The property is to be let as a 5 bed unit and based upon the Housing Department Standard Tenancy Agreement at the existing rent level for a property of this size, which includes the following:

 

  • Fair rent at £303.73;
  • Water rates £7.47;
  • GST £ 0.38

 

Total charges for this property is currently £311.58 per week; the rent will be subject to changes in fair rent levels consistent with other social rented housing.

 

The Tenant

 

The property is to be occupied by the Caring Hands Charitable Trust (settlement date 31st March 2011) and operates under the original Trustees of Mr. Colin Taylor, The Reverend Mark Bond and Deputy Sean Power; with the purpose of undertaking the commencement of an adult agency, in particular the provision of a men’s refuge.

 

The Charity currently runs Sanctuary House, a charitable facility for men in St Aubin that provides care, refuge and a temporary place to live whilst these men sort out their problems. Sanctuary House has been operating at its 11 bed capacity since it opened in the early part of 2011 and an additional 6 beds are presently being rented from a St Aubin Bed and Breakfast.

 

Resource Implications

The Housing Department will receive £16,202.16 per annum in rent.

 

Recommendations

That the Minister agree to the occupation, by Caring Hands Charitable Trust, of 63 New Street with effect from 1st April 2012.
