Road Traffic (St Ouen) (Jersey) Order: Amendments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister agreed to include two further items to the forthcoming amendment to the Road Traffic (St Ouen) (Jersey) Order 1979.

Reason(s) for Decision: To introduce 6 feet 6 inches width restrictions on Le Mont Matthieu and La Verte Rue, L’Etacq, with the exception of allowing access to premises situated on or adjacent to the road, or vehicles engaged in road sweeping or gully cleaning.

Resource Implications: Law drafting time. Transport and Technical Services implementation time £300.

Action required: Officers to instruct the Law Draftsman to include the above items in the forthcoming Amendment to the Order, for subsequent submission to the Minister.

REQUEST FROM THE PARISH OF ST OUEN FOR AN AMENDMENT TO THE

 

ROAD TRAFFIC (ST OUEN) (JERSEY) ORDER 1979

 

 

Purpose of the Report

 

To amend the Road Traffic (St Ouen) (Jersey) Order 1979.

 

 

Background

 

On 28 May 2010 the Minister for Transport and Technical Services approved a request from the Connétable of St Ouen to pass an Order to extend the current prohibition of waiting on both sides of La Rue des Cosnets, and introduce a section of  prohibition of waiting on the east side of La Rue des Marettes

 

However the Connétable has requested two further items to be included in the Amendment, with regard to introducing 6 feet 6 inches width restrictions on Le Mont Matthieu and La Verte Rue, L’Etacq, with the exception of allowing access to premises situated on or adjacent to these roads, or vehicles engaged in road sweeping or gully cleaning.  

 

 

Discussion

 

The request with regard to Le Mont Matthieu is considered necessary to prevent large vehicles from using the hill following remedial work to repair subsidence. The St Ouen Roads Committee are concerned that such vehicles, particularly coaches, put particular pressure on the road and could cause possible further subsidence on this winding, narrow Parish Road.

 

The request with regard to La Verte Rue, L’Etacq is considered necessary as this is also a narrow Parish Road with an open ditch to the side of the road over most of its length, and which is now showing signs of subsidence. With the probable future development of the “Milano Bars” site on this road, the Parish wish to control the access by heavy vehicles on this section of the road.

 

 

Recommendation

 

The Minister is recommended to approve the request.

To include in the forthcoming Amendment to the Order, 6 feet 6 inches width restrictions on Le Mont Matthieu and La Verte Rue, L’Etacq.

             

 

Action Required

 

The Minister to request Officers to instruct the Law Draftsman to include the above items in the forthcoming Amendment to the Order for subsequent submission to the Minister.
