Road Racing (Motor Vehicle Rally) (Jersey) Order 2007.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

THE JERSEY MOTOR CYCLE AND LIGHT CAR CLUB’S APPLICATION FOR THE JERSEY CAR RALLY 2007 & 25 th ANNIVERSARY VICTORIA AVENUE STAGE
 

1.0 Purpose of the Report

To obtain Ministerial Decision regarding approval of the Jersey Motor Cycle and Light Car Club’s Jersey Car Rally and 25th anniversary Victoria Avenue special race stage.

2.0 Background

The Promoter (The Jersey Motor Cycle and Light Car Club) has submitted details of its proposed route stages for the 2007 Jersey Car Rally to take place on Friday 12th and Saturday 13th October (see attached Stage Rally Stage Plan & Schedule).

In the light of 2007 being the 25th anniversary of the Rally, the Promoter has requested approval for a special race stage on Victoria Avenue on the evening of Friday 12th October.

The Promoters initial request to the Department was for a course that uses the full width of Victoria Avenue between West Park and La Rue du Galet, including the west and eastbound carriageways, lay-bys 1 to 6, the promenade strip and the areas around the shelters/gardens. TTS Management Team have expressed the view that the use of public spaces (other than the carriageways/lay-bys) as part of the course presents concerns, both in respect of the risk of damage to fixed assets (inc. the sea wall parapet and shelters) and what is the appropriate use of these public spaces. Therefore ‘in principal’ approval has been given for this special stage, on the basis that the course is restricted to the carriageways and lay-bys only. The Promoter has accepted this condition and the Order has been prepared accordingly.

The event is enabled by Order of the Transport and Technical Services Minister under Article 2 of the “Motor Vehicle Races (Jersey) Law 1946” and Article 2 of the “Entertainments on Public Roads (Jersey) Law 1985”.

3.0 Victoria Avenue Stage

3.1 Traffic Management, Road Closures & Access

The Promoter wishes to hold the Rally on Victoria Avenue on Friday 12th October from 7pm to 11pm, between West Park and La Rue du Galet.

Total traffic management and road closure measures required will be similar to those implemented for the 2007 Battle of Flowers, with traffic diverted on to La Route de St. Aubin at West Park and Bel Royal. Westbound traffic on La Route de St. Aubin will be able to re-access Victoria Avenue from La Rue du Galet and ‘by-pass’ the Bel Royal bus lay-by. Traffic wishing to go up St. Peter’s Valley will however be permitted to continue along the inner road as per normal.

The actual requested closure times are as follows:

  • From 7am to midnight: Lay-bys 1 to 6 (to allow placing/removing of materials etc.)
  • From 6.30pm to midnight: Victoria Avenue & Promenade, Tynevillle Lane, Paris Lane, First Tower Link Road, Farley’s Lane (to allow placing/removing of materials and pre race safety inspections etc.)

 

Note: To facilitate traffic flow, as per the Battle of Flowers, road side parking will require suspension on La Route de St. Aubin & Gloucester Street from 4p.m. to midnight .

Access to premises will be arranged on a case by case basis via the Rally’s Stage Commander, however all access to and from the beach will be prevented.

3.2 The Course

The Promoter has proposed a course that uses the full width of Victoria Avenue, including the west and eastbound carriageways and lay-bys 1 to 6. The aim of using these areas is to create a varied and challenging course that is 2.4 miles long.

The course as proposed has been approved by the Motor Sport Association and incorporates chicanes throughout its length to prevent excessive speeds, with average speeds likely to be less than 65 mph. The Rally also operates a scoring system which penalises collisions with obstacles with the aim of avoiding damage to surroundings. In addition various collision barriers will be used to protect the Department’s fixed assets, such as Shelters, Traffic Signal Poles etc. However £30 million public liability insurance will be in place should damage occur.

3.3 Other Provisions

In addition to the use of Victoria Avenue the Promoter wishes to use the area of promenade south of the Grand Hotel as a competitor holding point (20-35 cars at a time) and to allow the public to view the parked cars. The principal spectator point will be the Lower West Park (administered by the Parish), where a 2m exclusion strip will be placed behind the southern boundary wall adjacent with the course to provide a safety zone. It is anticipated that a marquee will be erected on the park to provide refreshments etc.

3.4 Traffic Impact

The requirement to close Victoria Avenue will, as in all cases, cause significant delays to traffic diverted on to La Route de St. Aubin. However given the timing of the closure from 6.30pm to midnight, disruption to peak traffic will be reduced. Also a precedence for an event of this type on Victoria Avenue has already been established with the ‘Festival of Motoring’ (Friday 8th June), which required the closure of the Avenue from 7pm to 11pm.

Approval of the Rally stage on Victoria Avenue will bring the total number of closures of the road for events in 2007 to six (inc. Marathon on October 7th), however the total number of established annual events remains unaltered at 3.


 

4.0 Other Stages

The proposed route stages for the Car Rally around the Island have been approved by the Connétables of each relevant parish. The club has also carried out consultation with all residents affected by the chosen routes. The Department has received one direct complaint regarding this year’s proposed route stage in the Parish of St. Martin. Following dialogue with the Promoter the particular road in question (La Rue de la Clochette) has been removed from this stage.

Otherwise the club endeavours to use stages every alternate year in order to minimise disruption to residents and the proposed stages this year are variations on those successfully used in 2005.

5.0 Recommendation

The Minister is recommended to give approval for the special 25th anniversary race stage on Victoria Avenue and the Road Racing (Motor Vehicle Rally) (Jersey) Order 2007 as prepared.

6.0 Action Required

Advise the Greffier that the Order has been made and forward the Decision Summary, Report, together with the signed and sealed Order, to the Publications Editor at the States Greffe.
