Clos de Roncier Refurbishment – Land Swap with Jersey Electricity Company Limited.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister agreed to the proposed land swap between the Public and the Jersey Electricity Company Limited.

Reason(s) for decision:

To approve the transaction in order that in accordance with Standing Order 168 (1) (a) and 168 (3) the Treasury & Resources Minister can notify the States of his acceptance of recommendations to dispose, acquire, let or rent land on behalf of the public of Jersey.

Action required:

The Treasury & Resources Minister to be asked to seek the approval of the States.

PROPOSED LAND SWAP WITH THE JERSEY ELECTRICITY COMPANY TO ALLOW FOR THE UPGRADING OF MAINS ELECTRICITY SUPPLY

AT CLOS DE RONCIER.

Clos de Roncier is an estate which comprises 79 three bedroom houses, four two bedroom houses and 4 one bedroom flats. The estate has been administered by the Housing Department since the first 18 houses (Phase 1) were built in 1952. Phases 2 and 3 saw the development of 79 three bedroom houses in 1970.

The estate also houses two JEC electrical substations which are owned by the JEC.

In July 2004 the States agreed to allow the Housing Committee to sell a small number of isolated vacant properties, the proceeds from which would be used to fund the refurbishment of Clos de Roncier.

The first phase of this work started in August 2005, with houses 1-18 (the 1950s homes) being fully refurbished. In addition to this work, it was intended to replace the existing solid fuel heating systems with an all electric night storage heating system. In order to do this – both for the first phase and latter phases – the JEC needed to replace the main electrical supplies to the estate.

It was proposed that the current sub-station, located in the garden of house number 20, and owned by the JEC, be replaced with a new sub-station in the garden of No. 22. This allowed the new cabling to be installed whilst the existing system was still operational. This work is now complete. The JEC own the land upon which the original sub-station was situated and have proposed a like for like land swap of that land for the land upon which the new sub-station is situated.

Recommendation

That the Minister approves the land swap with the JEC to regularise the ownership of the land and requests that the Treasury & Resources Minister seek the approval of the States for the transactions.
