Sea Fisheries (Bag Limits) (Jersey) Order: Proposed amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

 

For the Assistant Minister to request legislative drafting time to make an amendment to Sea Fisheries (Bag Limits) (Jersey) Order 2016 with respect of bag limits for several recreationally targeted species

 

Background

 

The Marine Resources team have conducted a comprehensive review of recreational fishing in Jersey identifying the species that are currently targeted or may, in the near future, become targeted for domestic consumption.

 

The review has resulted in a recommendation for the introduction of 45 new recreational bag limits covering 102 species and/or family groups of marine fauna.

 

The bag limits are designed to allow people to enjoy the sport of fishing and obtain a good feed from the targeted species while also safeguarding the resource from needles overexploitation.

 

Details

 

Species, or groups of closely associated species of marine fauna have been identified and assessed in terms of their abundance, biology and resilience to exploitation. From this, a set of bag limits were proposed with both individual allocations and maximum boat allocations as is already established in the Ormer bag limits.

 

For any species that is easily distinguished and that is targeted specifically by recreational fishers an individual bag limit has been recommended. For species that are either targeted as a group through a single fishing technique or species that are difficult to tell apart a grouped bag limit is proposed.

 

In the case of species or groups where hundreds of individuals may be gathered a weight based limit has been recommended in preference to a number of individuals.

 

Through consultation with the Minister for the Environment’s Marine Resources Panel and key sector representatives the proposed bag limits have been refined to a point where they have gained the panel’s recommendation for implementation.

 

 

Recommendation
 

The Assistant Minister is recommended to request legislative drafting time for amendment to the Sea Fisheries (Bag Limits)(Jersey) Order 2016.
