Road Traffic (St Lawrence) (Jersey) Order - Amendments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): To amend the Road Traffic (St Lawrence) (Jersey) Order 1990.

Reason(s) for decision:

To introduce prohibition of waiting on small sections of Mont Cambrai and to extend prohibition of waiting areas on La Route de St Aubin.

Action required:

Officers to instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.

TRANSPORT AND TECHNICAL SERVICES

AMENDMENT TO THE ROAD TRAFFIC (SAINT LAWRENCE) (JERSEY) ORDER 1990

Purpose of the Report

To improve traffic flow on two main roads in the Parish of St Lawrence.

Background

1. The Connétable of St Lawrence has written to the Department requesting the Minister for Transport and Technical Services to amend the Parish Traffic Order to prohibit waiting on sections on Le Mont Cambrai.

2. Due to two new pedestrian refuges being constructed on La Route de St Aubin, it has become necessary to request the Minister to reduce two sections of parking on the south side of the road and include these in the above Order Amendment.

Discussion

1. The request with regard to Le Mont Cambrai is considered necessary due to vehicles parking on the north side of the lower part of the hill, and causing vehicles travelling up the hill to drive on the wrong side of the road, prior to the first hairpin bend and therefore causing a danger to vehicles travelling down the hill.

2. The requests with regard to La Route de St Aubin are considered necessary due to two pedestrian refuges being constructed on La Route de St Aubin in the vicinity of building developments that are nearing completion out along this road. One of these sections of reduced parking is currently covered, temporarily, for a period not exceeding 12 months under Article 68 of the Road Traffic (Jersey) Law 1956, as amended, and this will be required to be included in the above Order.

Recommendation

The Minister is recommended to approve the requests.
