Appointment of Assistant Chief Minister with responsibility for Financial Services

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Appointment of Assistant Chief Minister with responsibility for Financial Services

Decision(s):  The Chief Minister agreed to appoint Senator P.F.C Ozouf as an Assistant Chief Minister. This decision replaces Senator Sir Philip Bailhache with Senator P.F.C Ozouf.

Reason(s) for Decision: Under Article 25 (a) and (b) of the States of Jersey Law 2005, the Chief Minister may appoint no more than 2 elected members as his or her Assistant Ministers, and remove any of his or her Assistant Ministers. This decision appoints Senator P.F.C. Ozouf as an Assistant Chief Minister with responsibility for Financial Services to replace Senator Sir Philip Bailhache following the latter’s appointment by the States’ Assembly to the post of Minister for External Relations on 10th September 2013.

This decision reflects the changes to the functions exercised by the Chief Minister as a result of the States Assembly’s approval on 18th July 2013 of the Chief Minister’s proposition P.75/2013 – States of Jersey (Transfer of Functions No.6) (Economic Development and Treasury and Resources to Chief Minister) (Jersey) Regulations 201-, transferring responsibility for the financial services industry to the Chief Minister’s Department. This decision gives administrative effect to the statement the Chief Minister made in the States Assembly on 17th April 2013 where he stated that Senator P.F.C Ozouf would help with the operational responsibility for Financial Services, in order that the Island can continue to move quickly on implementing the recommendations from global advisers regarding the opportunities for Jersey as an international finance centre.

Resource Implications:  There are no financial or resource implications.

Action required: A report will be lodged au Greffe to advise all States Members on the Assistant Minister position.
