Pier Road Car Park: Level 1: Shopper Parking: 3 Hour Limit

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision: To trial a parking incentive to aid St Helier retailers.

SHOPPER PARKING IN PIER ROAD CAR PARK LEVEL 1

Purpose of the Report

 

To change the maximum permitted stay period on Level 1 of Pier Road Car Park from Monday 30 November 2015 for a temporary period.

 

 

Background

 

With the current works being undertaken in Ann Place and Charles Street Car Parks to re-route the Town Brook, there is a temporary loss of parking serving the North and East of St Helier. With the approach of the Christmas shopping period and retailers still encountering difficult times, Transport and Technical Services believe this initiative may help them which can only be beneficial to the general Island economy.

 

Level 1 in Pier Road Car Park has 59 spaces and it is proposed that from Monday 30 November 2015 for a temporary period these spaces be changed to a maximum stay period of three hours instead of the current seven consecutive days to enable their use by shoppers wishing to visit St Helier retailers in the run up to Christmas. If the scheme proves successful it will be continued into 2016 and may assist when spaces are temporarily lost in Sand Street Car Park due to planned refurbishment. Some of the spaces lost in Sand Street Car Park due to these essential works have been provided for by the recent creation of 75 shopper spaces in Esplanade Car Park but these are now well used and occupied during the day.

 

Currently Pier Road Car Park has an average of 350 spaces available throughout the day so the loss of the 59 spaces on Level 1 will not result in the loss of occupied commuter parking.

 

The temporary changes can be introduced under Article 68 of the Road Traffic (Jersey) Law 1956 by the placing of appropriate signage and publication in the Jersey Gazette. The Road Traffic (Public Parking Places) (Jersey) Order 2006 is created under Article 59 of the Road Traffic (Jersey) Law 1956.

 

The Road Traffic (Public Parking Places) (Jersey) Order 2006 is administered by the Transport and Technical Services Department.

 

 

Discussion

 

The temporary creation of an additional 59 shopper parking spaces on Level 1 of Pier Road Car Park will help St Helier retailers during what is traditionally their busiest period and will assist in replacing spaces lost during the planned refurbishment of Sand Street Car Park during 2016.

 

 

 

 

 

Recommendations

 

The Minister is recommended to approve the temporary introduction of 59 three hour maximum stay shopper parking spaces on Level 1 of Pier Road Car Park and to instruct Officers to produce the necessary signage and advise the public using local media and to place the statutory Gazette inserts.

The provision of 59 temporary three hour maximum stay shopper parking spaces may assist local businesses within St Helier.
