Sale of an area of land at Balleine Close to the Parish of St. Clement.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): 

1. The Minister accepted the recommendation of the Minister for Housing (MD-H-2008-0002), in relation to the sale of an area of land at Balleine Close St Clement to the Parish of St Clement for the sum of £500 plus the Public’s legal costs.

Reason(s) for Decision: 

1.  Under Standing Order 168 (1) (a) and 168 (2) (a) & (b) the Minister accepted the recommendation of a body established by the States to manage land and buildings owned by the public of Jersey in respect of the disposal of land. 

2.  Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.

Resource Implications: 

There are no financial or manpower implications in respect of this decision.

Action required: 

1.  The Director of Estate Services (Housing) is to instruct the Attorney General and the Greffier to pass the necessary contract, and the Director of Property Holdings to copy this decision to the Assistant Minister, the Treasurer and Deputy Treasurer, the Minister for Housing and the Director of Estate Services (Housing).

Property Transaction for Ministerial Decision - Minister for Treasury and Resources  

Sale of an area of land at Balleine Close to Parish of St Clement.

PG 258  

Purpose  

To seek approval from the Minister for Treasury and Resources to allow the Public to sell an area of land at Balleine Close, St Clement to the Parish of St Clement. 

Background  

On the 13 July 1990 the Public acquired land at Balleine Close, La Rue de la Croix, St Clement from the Parish of St Clement for the construction of 5 social rented homes.  The Parish retained a property, at the entrance of the estate, known as the Halt.  The Parish now wish to sell this property and as part of the work undertaken to date it has been identified that the boundary wall of the property sits on the Public’s land and, consequently there is a small parcel of land belonging to the Public within the boundary wall of the Halt. 

Current Situation  

The Minister for Housing seeks the acceptance of the Minister for Treasury and Resources to the terms and conditions which have been agreed between the Housing Department on behalf of the Public and the Parish of St Clement to sell that area of land to the Parish for the sum of £500.00 with the Parish paying the Public’s legal fees. 

Conclusion  

The Minister for Housing seeks the acceptance from the Treasury and Resources Minister to the sale. 

Recommendation  

It is recommended that the Minister for Treasury and Resources approves the sale of the area of land at Balleine Close St Clement for the sum of £500.00 to the Parish of St Clement, and authorises a suitable contract to be passed before the Royal Court.   Accordingly it is recommended that the decision of the Minister for Housing is accepted.
