Civil Aviation Security Activities: Memorandum of Understanding with United Kingdom Department of Transport

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   Memorandum of Understanding regarding Civil Aviation Security Activities  

Decision(s):  The Chief Minister authorised the Director of Civil Aviation to sign, on behalf of the Chief Minister’s Department, the attached Memorandum of Understanding regarding aviation security between the Department for Transport for the United Kingdom and the Chief Minister of Jersey regarding civil aviation security activities. 

Reason(s) for Decision: The Memorandum of Understanding (MOU) is between the UK Department for Transport and the Chief Minister (who now has political responsibility in Jersey for aviation security).  This replaces the previous MOU between the DfT and the Minister for Economic Development.   

In addition, this MOU updates references with particular regard to the implementation of new arrangements under the Aviation Security (Jersey) Direction 2012. 

The MOU defines the respective roles of the DfT and the Chief Minister (via the Director of Civil Aviation) in relation to civil aviation security activities in the Bailiwick of Jersey.

The Law Officers Department has reviewed the MOU and indicated they are content. 

Resource Implications: There are no manpower or revenue implications arising.

Action required:  The Chief Minister’s Department shall –

  • return a signed copy of the MOU to the Department for Transport;
  • Inform the Assistant Greffier of the States of the decision

Civil Aviation Security Activities: Memorandum of Understanding with United Kingdom Department of Transport

REPORT

Memorandum of Understanding regarding aviation security between the Department of Transport for the United Kingdom and the Chief Minister of Jersey.

Background

 

The independent regulation of civil aviation security is a requirement of international organisations (ICAO), the European Union and the UK Department for Transport Security and Contingency Directorate (‘Transec’).

 

In February 2012, the State approved arrangements to –

  • Transfer the functions under the Aviation Security (Jersey) Order 1993 from the Minister for Economic Development to the Chief Minister
  • Amend the Civil Aviation (Jersey) Law 2008, by Regulations under Article 10, to insert additional functions of the Director of Civil Aviation with regard to aviation security.

An Aviation Security Regulator was appointed, in collaboration with Guernsey, to take up the responsibilities of the aviation security functions with effect from 27 February 2012.

 

Memorandum of Understanding

 

The Memorandum of Understanding (MOU) is between the UK Department for Transport and the Chief Minister (the Minister to whom responsibility for aviation security has been transferred).  This replaces the previous MOU between the DfT and the Minister for Economic Development in Jersey. 

 

In addition, this MOU updates references with particular regard to the implementation of new arrangements under the Aviation Security (Jersey) Direction 2012. 

 

The MOU defines the respective roles of the DfT and the Chief Minister in relation to civil aviation security activities in the Bailiwick of Jersey, as follows:

 

  • International obligations of the UK and Jersey in respect of the Convention on International Civil Aviation (the Chicago Convention).
  • Responsibilities of the DfT to consult and advise Jersey on international and national matters relating to aviation security, to facilitate participation in international forums, and to provide advice through the Director of Civil Aviation and / or the Aviation Security Regulator, to the Chief Minister.
  • DfT to carry out inspections, at the request of Jersey authorities, and to report on Jersey airport security arrangements.
  • Chief Minister, via the DCA, to seek expert advice on aviation security, and to comply with international standards; to adopt relevant legislation and to action any necessary recommendations on security standards.
