Fiscal stimulus: Road resurfacing West Park to Cheapside, St. Helier

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Economic Stimulus Plan: budget allocation to the Transport and Technical Services department for the delivery of the West Park to Cheapside (Phase 1) project.

Decision(s):

The Minister approved the allocation of £228,000 to the West Park to Cheapside (Phase 1) project to the Transport and Technical Services department, which will be transferred to the department budget as soon as possible. This will enable the construction contract to be let to the contractor which submitted the preferred tender. 

He further instructed the civil infrastructure project group to report on spend of all stimulus monies, and project progress/performance, on a monthly basis in accordance with guidelines set by the Treasury.

Reason(s) for Decision:

A discretionary fiscal stimulus allocation from the Stabilisation Fund of £44m has already been approved. The project meets the key criteria for fiscal stimulus being timely, targeted and temporary and will benefit local business and individuals. The £228,000 allocation to the project will enable the civil infrastructure project group to let the contract and deliver the scheme in accordance with the critical path.

Resource Implications:

No financial resource implications other than those explained above and in the accompanying report.

No manpower resource implications. 

Action required:

Treasury to be informed of decision to release necessary funds to the Transport and Technical Services department budget.

Fiscal stimulus: Road resurfacing West Park to Cheapside, St. Helier

Allocation of fiscal stimulus funding to Transport and Technical Services in respect of the West Park to Cheapside Project  

3 rd December 2009  

Background  

TTS were awarded provisional approval for 9 fiscal stimulus projects, including 3 highways projects which emerged as priorities for repair and resurfacing following condition survey undertaken in October 2007.  

Two of these projects are underway and nearing completion and this decision refers to the third scheduled project for resurfacing the B87 from West Park to Cheapside.  

The repair and resurfacing of this road is being delivered in 2 phases with a break awaiting a planning decision. Phase 1 is the larger phase from West Park to the Shipwright public house. This will leave a residual small section of the road which is scheduled to be undertaken in quarter 3 of 2010 and will be subject to an independent ministerial decision. 

The Tenders have now been received and evaluated for Phase 1 of this project. The evaluation process adopted by TTS has been subject to review by the Fiscal Stimulus Steering Group (the “Steering Group”) to determine that the outcome satisfies the specific Stimulus requirements of being timely, targeted, temporary, achievable and presenting value for money. 

Tender Process and Results  

The Fiscal Stimulus Steering Group accepts TTS assurances that they have followed their pre-determined processes in conducting the tender which will be subject to audit in the normal course of events.

The FSSG finds that the preferred tender meets the further criteria of the Discretionary Fiscal Stimulus. 

Recommendation from the Fiscal Stimulus Steering Group  

The Steering Group recommends that the Minister for Treasury and Resources allocates funding of £228,000 to the Westpark to Cheapside project and approves the transfer of that amount to a new capital head of expenditure.
