Health and Social Services budget transfer to various capital projects

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Transfer of Health and Social Services revenue to capital to balance Completed Works.

Decision(s): The Minister for Treasury and Resources approved the transfer of £181,035.89 from Health and Social Services Revenue Reserves to the following capital projects sitting within Completed Works.

Reason(s) for Decision: Financial Direction 3.6 and the Public Finance (Jersey) Law 2005, state the approval of the Minister for Treasury and Resources is required for any variations to heads of expenditure above £100,000.

Resource Implications: There are no financial or manpower resource implications other than those noted in the report.

Action required: Finance Manager to inform Finance Director, Health and Social Services Department, that the revenue to capital transfer has been approved.

TREASURY AND RESOURCES MINISTER  

health and social services – transfer of revenue to capital to balance completed works 

  1. Purpose of Report

The Minister for Health and Social Services has requested the Minister for Treasury and Resources to approve the transfer of £181,035.89 from revenue to capital to balance its Completed Works ledger.  Under Financial Direction 3.6 and the Public Finance (Jersey) Law 2005, the approval of the Minister for Treasury and Resources is required for any variations to heads of expenditure above £100,000.  

  1. Background

In 2008 Health and Social Services Department had completed three capital projects which were due to be transferred from the Assets Under Course of Construction (AUCC) ledger to Completed Works ledger.  These projects had the following expenditure amounts outstanding:-

The Department reported in the Financial Report and Accounts 2008 that these projects required funding and that they were in discussion with Property Holdings as to how the position was to be resolved.  Treasury and Resources Department required Health and Social Services Department to meet this funding from their existing cash limits.

The Department has allocated 2009 funding from its Revenue Reserves to match the expenditure and has requested that these funds are transferred in order to complete the process.

That the Minister for Treasury and Resources approves Health and Social Services request to transfer £181,035.89 from revenue to capital to balance the Completed Works ledger.
