Proposed sale of land at York Lane St Helier

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

 

1. The Minister accepted the recommendation of the Minister for Housing (MD-H-2008-0074) for the sale of land at York Lane, St Helier.

 

Reason(s) for Decision:

 

1.  Under Standing Order 168 (1) (a) and 168 (2) (a) and (b) the Minister accepts the recommendation of a body established by the States to manage land and buildings owned by the Public of Jersey in respect of the sale of land and hereby notified the States that he had accepted the recommendation of Property Holdings to agree to the above land transaction.

 

2.  Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.

 

Resource Implications:

 

Other than those detailed in the report there are no further financial or manpower Implications.

 

 

Action required:

 

1. In accordance with Standing Order 168 (3) this decision must be presented to the States at least 15 working days before the contract is passed.  After the expiry of 15 working days following presentation to the States the transaction may be concluded.

 

2.  The Director of Property Holdings is to instruct the Attorney General and the Greffier to pass the necessary contract, and to copy this decision to the Chief Executive of the Housing Department, the Minister, Treasurer and Deputy Treasurer.

Property Transaction for Ministerial Decision - Minister for Treasury and Resources

 

Proposed sale of land at York Lane, St Helier

Purpose

 

To seek approval from the Assistant Minister for Treasury and Resources for the public to sell an area of land at York Lane, St Helier in accordance with Housing Ministerial Decision MD-H-2008-0074.

 

Current Situation

 

The Parish of St Helier would like to acquire a small area of land measuring approximately 1,011 square feet, at York Lane at the junction with Old Street, which is already owned by the Parish. This has been a problematic area for some time and has fallen into use as a refuse collection area for local businesses and for fly tipping. There are also ongoing issues with the management of illegal parkers using the turning area at the bottom of Old Street. Both issues impact on residents of Hue Court.

 

The Parish of St Helier would like to address this and as part of its ongoing programme of regenerating areas of the town, would like to create an open amenity space in the area which it is hoped will be used by residents and town workers alike.  This would include the removal of the refuse bins and the cessation of parking in the area.  To facilitate this, the Parish needs to acquire this land from the Public.

 

Terms and conditions have been agreed between the Public and the Parish of St Helier to acquire the land for the sum of £10.00 with the Parish to meet the reasonable legal fees incurred by the Public in relation to this transaction.

 

Recommendation

 

It is recommended that the Assistant Minister for Treasury and Resources accepts the recommendation of the Minister for Housing to sell this area of land.
