Road Traffic (Amendment No 4) Law

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (23.06.06) to approve the draft Road Traffic (Amendment No.4) (Jersey) Law to allocate some speeding fines to the Parish concerned.

ROAD TRAFFIC (AMENDMENT No.4)( JERSEY ) LAW

SPEEDING FINES GATHERED BY PARISHES

Purpose of the Report

To progress a decision of the States and lodge the necessary amendments to the Law.

Background

In January, the States approved a Proposition from the Deputy of St Martin, amended by the Comité des Connétables, that fines gathered from speeding offences detected by the Honorary Police of parish and dealt with at the parish hall shall be for the benefit of the parish.

Discussion

The Minutes of the States for 31st January, 2006, record:-

THE STATES, following further consideration, adopted the proposition, as amended of the Deputy of St. Martin and –

(a) agreed that when a fine for driving at excess speed was levied by the Honorary Police in the Parish where the offence was committed, the fine should be for the benefit of that Parish and applied towards the general expenses of the Parish; and

(b) charged the Minister for Home Affairs, after consultation with the Crown and other appropriate authorities, to bring forward for approval the necessary amendments to the Road Traffic ( Jersey ) Law 1956, to give effect to the proposal.

In respect of (b), responsibility now falls on the Minister for Transport and Technical Services to bring forward the necessary amendments to the Law.

The Law Draftsman has prepared a draft amendment to the Law, namely the Road Traffic (Amendment No.4)(Jersey) Law, (copy attached) which if adopted by the States, sanctioned by the Privy Council and registered in the Royal Court will give effect to the proposal.

Recommendation

The Minister is requested to approve the draft Road Traffic (Amendment No.4)(Jersey) Law and lodge the draft in the States.
