Fiscal Stimulus: budget allocation to Housing Department for Les Chinq Chenes door replacements, and Brighton Close window replacements

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Economic Stimulus Plan: budget allocation to the Housing department for the delivery of two projects – door replacement at Les Cinq Chenes and window replacement at Brighton Close.

Decision(s):

The Minister approved the allocation of £210,229 to the department for the two projects, which will be transferred to the department budget as soon as possible. This will enable the contracts to be let to the contractors which submitted the preferred tender on the respective projects.   

He further instructed the Construction and Maintenance project group to report on spend of all stimulus monies, and project progress/performance, on a monthly basis in accordance with guidelines set by the Treasury, and return any unspent monies on completion of the project.

Reason(s) for Decision:

A discretionary fiscal stimulus allocation from the Stabilisation Fund of £44m has already been approved. The project meets the key criteria for fiscal stimulus being timely, targeted and temporary and will benefit local business and individuals. The £210,229 allocation to the project will enable the Construction and Maintenance project group to let the contract and deliver the schemes in accordance with the critical path.

Resource Implications:

No financial resource implications other than those explained above and in the accompanying report.

No manpower resource implications. 

Action required:

Treasury to be informed of decision to release necessary funds to the Housing department’s budget.

Allocation of fiscal stimulus funding for 2 Backlog Maintenance Projects - Les Cinq Chenes doors and brighton close windows  
 

  1. Purpose of Report

Tenders for the replacement of doors at Les Cinq Chenes and windows at Brighton Close have now been received and evaluated by the Housing department. The Tender returns have been subject to review by the Fiscal Stimulus Steering Group (the “Steering Group”) to ensure that the Fiscal Stimulus criteria continue to be met. This paper summarises the resulting recommendation.  

  1. Background

There are 26 discreet Housing backlog maintenance projects included in the Treasury and Resources Minister’s “amber light” programme of fiscal stimulus projects. The maintenance projects are designed to address deficiencies in meeting standards for decent homes. The work was already planned but without the Discretionary Fiscal Stimulus, it would have had to be delivered over a longer time period in order to meet funding constraints.  

All these projects will provide work for local business and labour, and are programmed to be undertaken in 2010 and 2011, significantly increasing public sector spending and investment in Jersey’s infrastructure.    

This paper seeks green light approval for the funding of the projects set out above.

Tender Process and Results 

The cost of the Les Cinq Chenes project is £80,341 and the cost of the Brighton Close project is £129,888. 

Housing have followed a pre-determined process in conducting the tender which they confirm to be compliant with Financial Directions and Procurement Principles for the Fiscal Stimulus Programme. The process and outcomes have been subject to review by the Steering Group, which has resulted in the recommendation below.

The Steering Group recommends that the Minister for Treasury and Resources allocates funding of £210,229 to Housing for the project and approves the transfer of that amount to new capital heads of expenditure. The budget allocation to Housing will be in the amount of £210,229, representing construction costs together with fees and appropriate contingency in order to proceed in accordance with the programme’s critical path.
