Lord Portsea Gift Fund: Application to Royal Court for Incorporated Body and Changes to Rules and Conditions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Lord Portsea Gift Fund: application to the Royal Court

Decision:

The Minister decided, in accordance with the States decision on 19th November 2013 to adopt the proposition on ‘The Lord Portsea Gift Fund: Proposed Rules and Conditions’ (P.126/2013), to make an application to the Royal Court for –

 

(a)   the Lord Portsea Gift Fund to become an incorporated body under the Loi (1862) sur les teneures en fideicommis et l'incorporation d'associations (‘the 1862 Law’); and

 

(b)   the incorporated body to include the changes to the rules and conditions of the Gift Fund that had been approved by the States in adopting P.126/2013.

Reason(s) for Decision:

In adopting P.126/2013 the States had agreed to change the rules and conditions of the Lord Portsea Gift Fund to take account of ministerial government, as well as a number of other changes, including altering the upper age of entitlement and extending the category of persons eligible for grants. The States had further agreed that application should be made to the Royal Court for the Fund to become an incorporated body under the 1862 Law, and for this incorporated body to include the changes agreed by the Assembly.

 

The necessary steps have now been taken to prepare the application for the Royal Court, and the approval of the Minister is required for the application to go forward.

The Law Officers’ Department will be requested to take the necessary steps for the application to be submitted to the Royal Court.
