Jersey Appointments Commission: Commissioner: Re-Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Deputy Chief Minister approved the report and proposition recommending Mr Julian Rogers is re-appointed for a second term as a Commissioner of the Jersey Appointments Commission for the

period until 23rd February 2014.

Reason(s) for Decision:

Re-appointments for a second term are in accordance the Jersey Appointments Commission Code of Practice on Appointments to Autonomous and Quasi-Autonomous Public Bodies and Tribunals and the requirements in the Employment of States of Jersey Employees (Jersey) Law 2005. On 23rd May 2013, the States Employment Board approved the Chief Minister’s recommendation to re-appoint Mr Julian Rogers as a Commissioner of the Jersey Appointments Commission for the period until 23rd February 2014.

Resource Implications:

There are no financial nor manpower implications associated with this decision.

Action required: The Greffier of the States to be requested to lodge ‘au Greffe’ the Proposition for debate by the States at the earliest opportunity.

The STATES are asked to decide whether they are of the opinion –

 

In accordance with Article 18 (7) of the Employment of States of Jersey Employees (Jersey) Law 2005,  which is concerned with the re-appointment of Commissioners to the Jersey Appointments Commission, to re-appoint  Mr Julian Rogers, as a Commissioner of the Jersey Appointments Commission until 23rd February 2014..

REPORT

 

Jersey Appointments Commission:  

Re-Appointment of a Commissioner

 

Introduction:

 

The Jersey Appointments Commission is established under the Employment of States of Jersey Employees (Jersey) Law 2005 Part 4.

 

The duty of the Jersey Appointments Commission is to oversee the recruitment of States’ employees and States’ appointees, in order to ensure that appointments are fair and conducted in accordance with best practice principles.

 

The Commission consists of a Chairman and 4 other commissioners. The Commissioners are required to meet 4 times per year, to contribute to the production of guidelines that will apply to States’ employees or States’ appointees, to audit recruitment and to oversee recruitment to senior posts.

 

The purpose of this report is in reference to paragraph 18(7) of this Law that permits the re-appointment of a Commissioner if the total period appointed is less than 8 years.

 

The Chief Minister wishes to recommend to the States of Jersey the re-appointment of Mr Julian Rogers as a Commissioner, for a second term, until 23rd February 2014. Mr Rogers will have been appointed for a total period of 4 years and 10 months in 2014.

 

On 23rd May 2013 the Chief Minister gained the approval of the States Employment Board to the re-appointment of Mr Julian Rogers and concluded that there would be merit in the timescale for this re-appointment coinciding with the expiry date of the current Chairman’s term of office.

Mr Julian Rogers, MA, MBA has been resident in Jersey since 1975 and owns and runs a software company working with a wide range of clients.  He developed and ran early adult IT Training courses while a full-time lecturer with the Business Studies department at Highlands. 

He has been Chairman of the States Members Remuneration Review Body since 2004 and held roles with the University of the Third Age, Jersey and The Probus Club of Jersey

He is a commercially-endorsed Yachtmaster.

Financial and manpower implications:

 

This proposal does not have any additional resource implications, as confirmed below –

There are no additional financial implications arising from this proposal, as there is already a budget in place for the costs associated with the running of the Appointments Commission.

 

Recommendation:

 

The Chief Minister requests that the States approves his recommendation to re-appoint Mr Julian Rogers as a Commissioner of the Jersey Appointments Commission for a period until 23rd February 2014.
