Overseas Aid Commission - Approval of payment of 3 applications

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the payment of 3 applications for overseas aid amounting to £36,000, agreed by the Overseas Aid Commission at their meetings on 4th, 10th and  26th November 2010. The Minister approved the payment of an533 applications for overseas aid agreed by the Overseas Aid Commission at their meetings on 4th, 10th November and  1826th OctoberNovember 20102010..approved the transfer of the Comprehensive Spending Review Team budgets and manpower from the Chief Minister’s Department to the Treasury and Resources Department with effect from 1 January 2010, along with all balances and transactions as at the date of transfer.  These comprised non-recurring budgets of £740,000 and a recurring budget of £76,600 and 1.0 FTE.

 

Reason(s) for Decision:

To approve the payment of overseas aid pending the appointment of an Accounting Officer to the Overseas Aid Commission.The Comprehensive Spending Review  (CSR) Team was set up under the Chief Minister’s Department to undertake the CSR in 2010. The Treasury is currently undergoing a restructure, part of which includes the creation of a Financial Planning Team, which is primarily a continuation of the CSR team beyond its original duration of 6 months. The transfer reflects the change of accountability for this new team.

 

 

Resource Implications:

Payment of expenditure of £3036,00049,000 from the Overseas Aid Commission budget; the budget remaining after these payments amounts 

 There is no overall increase to States Spending or manpower as a direct result of this decision which concerns the transfer of carry forwards which are non-recurring and 1 existing post.

 

However, the continuation of the Financial Planning team into 2011 is part of the overall Treasury restructure which is the subject of a growth bid of 6.00 FTEs and £550k as part of the 2011 Business Plan/Comprehensive Spending Review.to approximately £

204168,000.

Action required:
