A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined that his Intention to List or Register historic buildings or places, and the signing of Notices therein, could be made in private meetings but that any decisions where he would confirm the Listing or Registration of historic buildings or places would be made in public, unless opportunity for public representation had been previously given.

Reason(s) for Decision:

  1. By declaring his intent to List or Register an historic building or place, the Minister is effectively providing interested parties with a formal opportunity to make representations on his stated intention by virtue of the fact that any such decision results in the subsequent service of a Notice, advising of the Minister’s intent, and that there was no merit in making these decisions public;
  2. The confirmation of any Listing or Registration of an historic building or places in public provides opportunity for public representation to be made;
  3. This decision should ease efficiency and effectiveness of the administration associated with the determination of Notices of Intent for the Listing and Registration of historic buildings and places, and should promote clarity and efficiency in the business of public Ministerial meetings.

Legal and Resource Implications:

Article 51 of the Planning and Building (Jersey) Law 2002 requires the Minister to serve a notice of his intention to List, as a Site of Special Interest, a building or place: there is no legal requirement to make this decision in public.

This decision should assist administration of this process and thus reduce pressure on resources
