Amendment to the Road Traffic (Trinity) (Jersey) Order 1988.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Road Traffic (Trinity) (Jersey) Order 1988

Decision(s): The Minister made the Road Traffic (Trinity) (Amendment No 5) (Jersey) Order 2009, to become effective 14 days after it is made, the purpose of which is to improve the traffic management in the Parish by making Les Ruelles subject to a one way restriction in an easterly direction.

Reason(s) for Decision: At the request of this Department and the Connétable to amend the Road Traffic (Trinity) (Jersey) Order 1988 to allow the safe implementation of the part time 20 mph speed limit on La Grande Route de la Trinité, in the vicinity of Les Ruelles

Resource Implications: The cost of implementation of the Order will be approximately £500.00.  Funding is available from the Community Safety Fund in connection with part time 20 mph speed limits.

Action required: To send the hard copy of the Order to the Publications Editor at the States Greffe as soon as it has been signed.

TRANSPORT AND TECHNICAL SERVICES  

ROAD TRAFFIC (TRINITY) (JERSEY) ORDER 1988 - AMENDMENT  
 

Purpose of the Report  

To improve traffic safety on a road junction in the Parish of Trinity. 
 

Background  

On 10 October 2008 the Minister for Transport and Technical Services approved an Amendment to the above order to make Les Ruelles subject to a one way restriction in an easterly direction. 
 

Discussion  

The reason for this request is due to concerns that La Ruelle joins La Route de la Trinite at a steep angle with zero visibility onto the main road, thereby causing a danger to motorists and pedestrians. 

The school currently operates an informal one way system along La Ruelle at drop off and collection times. However, the Parish wish to formalise the restriction as there are safer alternative routes and outside school times very few vehicles would be displaced to the alternative routes.   

The Minister is requested to approve the attached Road Traffic (Trinity) (Amendment No 5) (Jersey) Order 2009 with regard to the above item to be included in the Road Traffic (Trinity) (Jersey) Order 1988. 
 

Recommendation  

The Minister is requested to approve the Amendment to be effective from two weeks after the Order is made.

To increase the safety for motorists and pedestrians by making La Ruelle one way in an easterly direction. 
 

Action Required  

The Minister to instruct his officers to process the Ministerial Decision.
