Police Negotiating Board: Appointment of Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for Home Affairs decided to approve the appointment of the Director General of the Justice and Home Affairs Department and the Head of Finance Business Partnering in the Treasury and Exchequer as Members of the Official Side of the Police Negotiating Board.

 

Reason(s) for Decision: To appoint members to represent the Minister on the Official Side of the Police Negotiating Board, in accordance with the provisions of Article 11 of the States of Jersey Police Force Law 2012 and Article 1 in the Schedule to the States of Jersey Police Force (Police Negotiating Board) (Jersey) Regulations 2017.

Police Negotiating Board: Appointment of Members

APPOINTMENT OF MEMBERS OF THE POLICE NEGOTIATING BOARD

13th November 2019

 

  1. Background

 

Article 11 of the States of Jersey Police Force Law 2012 and Article 1 in the Schedule to the States of Jersey Police Force (Police Negotiating Board) (Jersey) Regulations 2017 sets out the constitution of the Police Negotiating Board (referred to as the Board).

 

The functions of the Board are to negotiate with the States Employment Board (SEB) and make non-binding recommendations to the SEB on the terms and conditions of appointment of police officers.

 

  1. Current situation

 

The Board consists of an Official Side and a Staff Side.  The Official Side should consist of 4 Members, two of whom shall be appointed by the Minister for Home Affairs, and two of whom shall be appointed by the States Employment Board.

 

A member of the Official Side shall hold office until a new Council of Ministers is appointed and is eligible for re-appointment and a member of the Staff Side shall hold office for a period determined by the Association.

 

The last time the Minister formally appointed members of the Board was in 2012. The then Minister appointed the Chief Officer and the Finance Director of Home Affairs. Neither worked directly for the States of Jersey Police but had a strong link with the Force, had significant senior management experience and were fully capable or representing the Minister in negotiations. The Chief Officer and the Deputy Chief Officer of Police are not eligible to be members of the Board.

 

The Board has lay dormant for some time. During this time, the Government has undergone restructuring and the Chief Officer and Finance Director positions have changed. The equivalent positions are now the Director General of Justice and Home Affairs and the Head of Finance Business Partnering in the Treasury and Exchequer. Both are willing to represent the Minister on the Board.  

 

  1. Ministerial Recommendation

 

The Government is currently reviewing legislation relating to the police and so there is now a need to reconvene the Board.

 

The Minister is recommended to approve the appointment of the Director General of Justice and Home Affairs and the Head of Finance Business Partnering in the Treasury and Exchequer as members of the Police Negotiating Board.
