Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (10.03.06) to decide to appoint a consortium of consultants headed EDAW Ltd. for the St. Helier Development and Redevelopment Strategy.

St Helier Development & Regeneration Strategy

Background

Following a decision of the Policy & Resources Committee in October 2005 to establish a St Helier Task Force, that Committee and the former Environment and Public Services Committee agreed that it was necessary to commission a Development & Regeneration Strategy for St Helier.

The Chief Minister had determined that the Strategy must be substantially completed by the end of 2006. The St Helier Task Force decided to suspend the normal procedure for inviting consultants to express an interest in the project, and to approach five major United Kingdom consultants, who it was believed were capable of undertaking the study in the limited time available, to submit full tenders in accordance with a brief which is appended to this report. Invitations were sent out on 16 December 2005 and the closing date for the submission of tenders was 27 January 2006.

In the event, three tenders were submitted as follows:-

EDAW plc £239,192

Terence O'Rourke Ltd £362,155

Llewellyn Davies Yeang £273,000

The two other practices invited to tender, Donaldsons and Peter Brett Associates, having worked together before, joined forces with EDAW.

Selection Procedure

The three consortia were interviewed on 13 February 2006, by Constable Simon Crowcroft, John Richardson, Peter Thorne, Kevin Pilley, and Ian Williams of Hydraconsult Ltd., who in the meantime had been retained by the Department to act as a UK-based project manager. No decision was made to appoint on the 13 February, but additional information was sought from EDAW and Terence O'Rourke to clarify uncertainties in their submissions.

The further submissions were circulated to members of the interview panel, and it was agreed on 21 February that the EDAW consortium should be appointed to undertake the preparation of the Strategy in accordance with their original and additional submission. The panel considered that the EDAW team was strong in all areas, the submission was compliant with the brief, and the price was extremely competitive. Constable Crowcroft and Senator Cohen, as the political representatives of the St Helier Task Force on the panel, both agreed that EDAW should be appointed.

Recommendation

The Minister is asked to confirm the decision of the selection panel to appoint EDAW plc to undertake the St Helier Development & Regeneration Strategy.
