Travel and Entertainment Expenses 2011: Ministers and Assistant Ministers

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Travel and Entertainment Expenses 2011: Ministers and Assistant Ministers. 

Decision(s):  The Chief Minister agreed to present to the States Assembly the travel and entertainment expenses incurred by Ministers and Assistant Ministers during 2011.

Reason(s) for Decision:   Following a question during the Chief Minister’s ‘Questions Without Notice’ period on 7th November 2006, the Chief Minister agreed to publish on an annual basis the travel and entertainment expenses incurred by Ministers.

Resource Implications:  There are no financial or manpower implications. 

Action required:  The Policy & Research Officer to forward the report containing Ministerial expenses for 2011 to the States Greffe for presentation to the States Assembly.

Travel and Entertainment Expenses 2011: Ministers and Assistant Ministers

REPORT

 

At a meeting of the States on 7th November 2006, the previous Chief Minister was asked during ‘questions without notice’ about the travel and entertainment expenses incurred by Ministers.

 

The relevant extract from the States Minutes is given below –

 

“The Code of Conduct for Ministers, which was presented on 10th February, was largely copied and pasted from the U.K. Code of Conduct. However, the U.K. Code of Conduct includes that the government publishes an annual list of all travel overseas by Ministers, together with the total cost of Ministerial travel overseas. Will, at the end of these 12-month periods, the Chief Minister publish all travel and entertaining expenses by Ministers?”

 

The Chief Minister agreed to publish the expenses incurred by Ministers, and the travel and entertainment figures for 2011 are attached in the Appendix. The expenses incurred by Assistant Ministers have also been included.
