Statement of births, marriages and deaths during 2008

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision:

Article 75 of the Marriage and Civil Status (Jersey) Law 2001 requires the Minister for Home Affairs to report to the States each year the number of births, marriages and deaths registered in the preceding year.

Resource Implications:

There are no financial implications to the Home Affairs Department from this decision.

Action required:

The Executive Officer, Home Affairs to request the Greffier of the States to present the Statement to the States as a Report.

Report for Minister 
 

The Superintendent Registrar is pleased to present the Statement as to the number of births, marriages and deaths registered in the twelve parishes of the Island during 2008 to the Minister.  

Article 75 of the Marriage and Civil Status (Jersey) Law, 2001 requires that: 

“The Minister shall, each year, report to the States the number of births,  stillbirths, marriages and deaths registered, in the preceding year, pursuant to  this Law.” 

The delay in forwarding this statement is due to a combination of circumstances most of which relate to the change in staff at the Office and their inexperience of the systems.  The Superintendent Registrar took over in the final quarter of the year with only limited experience of certain aspects of her job including the collection and processing of the returns.  Some registrars were slow to make their returns within the first quarter of the year which further delayed the process.  At the same time she had to induct her two colleagues (one entirely new to the service) into their new posts and in the New Year had the unwelcome consequences of a water leak into her premises to deal with.     

As we are close to the year end, the option of reporting the 2008 figures at the same time as those for 2009 was considered. However, in view of the requirement to report ‘each year’, it was considered more appropriate to make the report in 2009, albeit later than normally expected. 

Recommendation: 

The Minister is asked to approve the Statement as to the number of births, marriages and deaths registered in the twelve parishes of the Island during 2008, as attached for publication.
