Comprehensive Spending Review: Budget Transfer from Restructuring Provision

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Transfer of funding from Restructuring Provision funds in support of the Comprehensive Spending Review (CSR) programme and transfer of budget from Treasury to Education, Sport and Culture.

Decision(s): 

 The Minister accepted a budget transfer of £306,300 from the Restructuring Provision to the Education Sport and Culture Department (ESC), the funding for which was agreed by the Council of Ministers on 29 November 2012, in support of the CSR programme.

 

Reason(s) for Decision:  The States recognised the need to invest funds to achieve savings when it approved a Restructuring Provision in the 2011 and 2012 budgets and the Council of Ministers acknowledges that further investment will be needed to ensure Public Sector Reform is successful. The MTFP has earmarked funds to provide for this funding over the next three years.

 

Article 2(6) of the Public Finances (Transitional Arrangements) (Jersey) Order 2011 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

Resource Implications:  Education Sport and Culture Department’s revenue head of expenditure to increase by £306,300 in 2013 and the Restructuring Provision to decrease by the same amount.  This decision does not change the total amount of expenditure approved by the States for 2013.

Action required: Finance Director Education, Sport and Culture to liaise with Treasury and Resources to effect the budget move
