A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister decided to appoint Kirsten Du Heaume and Wayne Balcome to serve as members of the Council for a three-year term of office with effect from 14 October 2020.
Reason(s) for Decision: The proposition and report on the Council, P 102, which was agreed by the States in 1991, provided for the Social Security Committee to appoint the members of the Jersey Council for Safety and Health at Work. The changes set out in machinery of government legislation have transferred the responsibility for the appointment of members to the Minister for Social Security.
Resource Implications: There are no implications for the financial or manpower resources of the States.
Action required: The Director of Health and Safety to notify the Chairman of the Council of the Minister’s decision.

Appointment of members to the Jersey Council for Safety and Health at Work

SUMMARY

The constitution of the Jersey Council for Safety and Health at Work, which was agreed by the States on the 30th July 1991, provides for the appointment of members to the Council by the Social Security Committee. With the introduction of Ministerial Government, the responsibility for appointment of members now rests with the Minister for Social Security.

The Minister is, therefore, requested to appoint Kirsten Du Heaume and Wayne Balcome, as recommended by Dr Stephen Taylor, Chairman of Council, to serve a three year term of office as members of the Council.

BACKGROUND

The Jersey Council for Safety and Health at Work

The Council is an independent body set up by the States to promote the health and safety of workers and others affected by work activities. The Council consists of a Chairman and four members who are appointed to serve a three year term of office. The Minister presents a report to the States notifying of their intention to appoint the Chairman, with the Minister appointing members to the Council.

The Council receives an annual grant to carry out its work and is required to submit an annual report and audited accounts to the States.

Proposed member

Council has sought two new members to replace a member whose third and final term of office has expired and a member who has resigned for personal reasons. The recruitment process has been carried out in accordance with the Jersey Appointments Commission Code of Practice.

As a result of this appointment process, Dr Taylor, Chairman of Council, has put forward the name of two new members, Kirsten Du Heaume and Wayne Balcome.

Kirsten Du Heaume has many years of senior managerial experience within the quarrying sector in Jersey, and has led a variety of successful engineering and operational projects. Wayne Balcombe has over 20 years of working within the utilities and Facilities Management, with a particular interest occupational health and safety.

Financial and manpower implications

Members of Council serve on an honorary basis and therefore this appointment has no implications for the financial or manpower resources of the States.

RECOMMENDATION

It is recommended that the Minister agrees to the proposal by Dr Taylor, Chairman of the Jersey Council for Safety and Health at Work, to appoint, Kirsten Du Heaume and Wayne Balcome, to serve on Council with effect from the 14 October 2020.
