Temporary amendment to the Road Traffic (St. Helier) (Jersey) Order 1996.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Temporary Amendment to the Road Traffic (St Helier) (Jersey) Order 1996.

Decision(s): The Minister approved the changing of the unloading bay on St Aubins Road outside “Le Marquand Brothers” to 20 minute pay-card parking, and the relocation of the unloading bay to replace the area of prohibition of waiting outside “West Park Pharmacy” on St Aubins Road.  

Reason(s) for Decision: To address concerns of a neighbouring business regarding the provision of parking that had been adjusted to accommodate an alfresco eating area at “La Catalina Restaurant” on St Aubins Road.

Resource Implications: Jersey Gazette notice - £80. Road marking and signage £150. Officers time 4 hours.

Action required: The Minister to instruct his officers to arrange for a notice to be inserted in the Jersey Gazette, as required by Article 68 of the Road Traffic (Jersey) Law 1956.

ST AUBINS ROAD TEMPORARY AMENDMENT TO CHANGE PARKING ARRANGEMENTS ON ST AUBINS ROAD  
 

Purpose of the Report  

To make a temporary amendment to the Road Traffic (St Helier) (Jersey) Order 1996 

Background

 

As a result of a request by “La Cantina Restaurant” on St Aubins Road to make alterations to the footpath outside of restaurant to facilitate alfresco eating, this Department, with the support of the Connétable of St Helier requests the Minister to make a temporary amendment to the Road Traffic (St Helier) (Jersey) Order 1996, under Article 68 of the Road Traffic (Jersey) Law 1956, as amended, to make alterations to the parking arrangements in the vicinity of the restaurant. 

Article 68 enables changes to Traffic Orders to be made, for a period of up to 12 months, without waiting for the relatively lengthy process of amending Orders to be completed. During the 12 months period an amendment to the Order will be drafted, for approval by the Minister. 

Discussion

A trial alfresco area has been in operation for a year at La Cantina Restaurant, on St Aubins Road. Plastic bollards were installed to guard pedestrians where they were displaced onto the road side, and temporary concrete ramps installed for wheelchair access. La Cantina wishes to make alterations to the footpath to accommodate the alfresco area on a more permanent basis. The plastic bollards would be removed and the granite kerbs re-laid on a new alignment with wheelchair access to enable the footpath to divert past the alfresco area. The works would be paid for by La Cantina which also pays an annual fee for the alfresco arrangement to the Parish of St Helier.

 

Le Marquand Brothers, situated next door to La Cantina, have raised concerns that the alfresco area dissuades motorists from parking in front of their shop, and have requested that the unloading bay is changed to pay-card parking. It is therefore proposed to move the unloading bay to the front of West Park Pharmacy and change the unloading bay to parking as requested, on a trial basis. All businesses on the roadside from La Cantina to Cheapside Corner have been consulted and no objections have been received. 

Recommendation 

The Minister is recommended to approve the attached notice, as required by Article 68 of the Road Traffic (Jersey) Law 1956, for a period not exceeding 12 months to come into effect within seven days after its insertion into the Jersey Gazette.

To change parking arrangements on St Aubins Road in the vicinity of La Cantina Restaurant.

The Minister to instruct his officers to arrange for a notice to be inserted in the Jersey Gazette, on two occasions, as required by Article 68 of the Road Traffic (Jersey) Law 1956.
