Road Traffic (St Helier) Order 1996 and Disabled Persons Parking Order 2005 Amendments.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister made the Road Traffic (Disabled Persons) (Parking) (Amendment No. 6) (Jersey) Order 2007 to come into force on 30th July 2007 and the Road Traffic (St Helier) (Amendment No. 21) (Jersey) Order 2007 to come into force on 30th July 2007.

Reason(s) for decision:

1. To include the various previously unscheduled unloading bays situated in the vicinity of the town centre and change unloading start time from 2am to 5am.

2. To make permanent two temporary Orders made under Article 68 of the Road Traffic Law 1956

3. To include several further requests from the Parish of St Helier, and this Department.

Action required:

To forward hard copies of the Orders to the Publications Editor at the States Greffe as soon as they have been signed.

ROAD TRAFFIC ( ST HELIER ) (AMENDMENT No.21) ( JERSEY ) ORDER 2007 AND ROAD TRAFFIC (DISABLED PERSONS) (PARKING) (AMENDMENT No.6) ( JERSEY ) ORDER 2007

Purpose of the Report

To amend the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.

Background

On the 20th April 2007, the Minister for Transport and Technical Services approved requests from the Parish of St Helier, and this Department, to amend the above Orders.

Discussion

The Minister approved the following requests:-

To include the various previously unscheduled unloading bays situated in the vicinity of the town centre in the Road Traffic (St Helier) (Jersey) Order 1996, and change the time when all unloading bays, with the exception of those in Patriotic Street, Bath Street, Halkett Place and outside the Market will be effective, from 2am to 5am.

To include, in the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005, two temporary Orders made by the Minister for Transport and Technical Services, under Article 68 of the Road Traffic (Jersey) Law 1956, with regard to changes to parking in Kensington Place, and Conway Street, to facilitate the St Helier Streetlife Programme.

In addition the Minister approved several further requests from the Parish of St Helier, and this Department, for inclusion in the amendments as follows:-

  1. Install parking for motor cycles and mopeds in Ingouville Lane.
  2. Extend a small section of prohibition of waiting in Cannon Street.
  3. Reduce the 1hour scratch card parking on the east side of Patriotic Street by 9 yards.
  4. Move the unloading bay in Don Street and install additional 20 minute scratch card parking.
  5. Install one 4 hour disabled persons parking bay in Hue Street.
  6. Install prohibition of waiting on a section of the eastern side of Pen-y-Craig Avenue.
  7. Install an additional resident’s parking space on the north side of St Marks Road.
  8. Install additional prohibition of waiting in St Marks Road.
  9. Provide two additional 20 minute scratch card parking bays in New Street.

Recommendation

The Minister is recommended to approve the Amendments to be effective from the 30th July 2007.
