Road Traffic (St. Helier) (Jersey) Order 1996: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST HELIER) (JERSEY) ORDER 1996 - AMENDMENT

 

REQUEST

 

 

Purpose of the Report

 

To amend the Road Traffic (St Helier) (Jersey) Order 1996 to make permanent the temporary amendments made under Article 68 of the Road Traffic Law and to introduce further restrictions to the Order.

 

 

Background

 

Temporary amendments under Article 68 of the Road Traffic (Jersey) Law 1956

 

Between August 2013 and May 2014 eight amendments to the Road Traffic (St Helier) (Jersey) Order 1996 were made using powers granted under Article 68 of the Road Traffic Law. These Amendments are temporary and after 12 months must be formalised into the Parish Road Traffic Order if they are to become permanent. TTS officers and Parish officials are now satisfied that the temporary amendments are still appropriate and therefore wish these changes to be included in the Parish Traffic Order.

 

 

Discussion

 

The temporary amendments made in 2013 are summarised below.

 

Schedule 10 - Unloading Bays

 

La Motte Street at its junction with Snow Hill: change in unloading times to 5.00am to 11.00am Monday to Saturday. Maximum period: 20 minutes. Between 11am and 5am no parking or unloading will be permitted.

 

Esplanade: North side, between a point 188 yards east of its junction with Castle Street and a point 12 yards further east – change in unloading times to 2am to 3pm Monday to Saturday. Maximum period: 20 minutes. Between 3pm and 2am Unloading and Parking will not be permitted.

 

 

Schedule 4 - Prohibition of Waiting

 

La Rue de Carteret: - In its entirety

 

La Rue de L’Etau - In its entirety

 

Vallee des Vaux: – west side from the northern boundary with Trinity to a point 40 yards south.

 

Grosvenor Street: Removal of the doctors parking spaces and to replace them with 1hour Pay Card spaces.

 

Schedule 1 – One Way driving routes

 

Hue Street - One way in a southerly direction from a point 56 yards north of Dumaresq Street to Dumaresq Street.

 

Schedule 2 - Prohibition or Restriction of Turns

 

Prohibition of Left-Hand Turns

St Clements Road: - West bound traffic heading along la Route du Fort will be prohibited to make the left turn into St Clements Road

 

Prohibition of Right-Hand turns

Farleys Lane: - East bound traffic will be prohibited to make the right hand turn from La Route de St Aubin into Farleys Lane.

 

 

Recommendation

 

The Minister is requested to approve the request.
